Hello, I took a cunsumer Loan from Capital First in may and my first EMI was due on 05/06/17 which i had paid on time but they reproduced the cheque against my bank on 07/06/2017 for the same EMI which i had already. Due to that my bank charged me 575 rs. for cheque bounce charges when i mailed them regarding this they were not keen of understanding the point or even contact a customer. (even they mailed after 5 working days) After this incident very next month in July i had appropriate balance in my bank account for EMI but i got the Text from Capital First that no EMI will be cut from my account in July month while i had enough balance in my account and after 25 days i got the text from their side to pay the July's EMI on immidiate basis or else my CIBIL score will be affected. Now if my repayment option is auto debit mode then why i should pay directly. & Their recovery agent came to my home by asking everyone in society stating that i havent paid my loan"s EMI while i had enogh balance in my account and after this very next day they deducted the amount from my account, So if they were able to deduct the amount then why they defamed me for not paying the EMI ehile amount was there. (I have the SMS & all the conversation mails as proof) I tried to contact their customer support team but i haven't get the reply yet. So i want to make a case of lake of services and defamation please advice.

I purchased a butted and bounded land about 50 years ago and constructed my own house as per municipal sanctioned plan. Since then I am residing here with good possession, title, right and interest with proper government revenue records. Recently, all on a sudden one of my neighbors’ who is in possession of a different C.S., R.S. and L.R. claimed that they own a piece of land inside my boundary and started creating nuisance and threatened to dismantle my 50 years old boundary wall. In consequence I was compelled to start a title suit and absolute injunction was granted in my favor. After several years of court proceedings my neighbor’s prayed for survey commission and the court appointed advocate commissioner. My queries are (1)Will the court now consider the advocate commissioner's report as absolute evidence to settle my neighbor’s claimed piece of land inside my butted and bounded property or is the commission report will be a part and parcel with the previous evidences that has been already placed in the court. (2) What are my options if I feel the submitted commission report has not been executed properly?

With the increase in population, there is a continuous surge in external persons/ traffic entering residential colonies to either illegally park their cars, take short cuts to avoid main roads, and just hang around in large numbers ending up dirtying and misusing Private property.
In many cases internal space is taken away by outsiders who permanently park their cars overnight, illegally create permanent jhuggis, food stalls, and sleeping rights by rickshaw pullers, taxi drivers etc.
To avoid this misuse, RWAs put up colony gates and where ever feasible keep them closed. However MCD and the Courts have never been in favour of the RWA keeping gates closed, and given rulings to keep gates open, under the ground of ease of movement, and objections by some residents.
My query is -Under what grounds and law can RWAs appeal in the Delhi Court to keep some of their Colony gates closed ?

R/sir,
i filed an application for set aside ex-party proceeding order after the laps of 11 years.
The i was arranged as performa defendant (defendant no. 2) i attended the court every date but because of lack of knowledge of legal proceeding i never informed by my lawyer about ex-party proceeding. when i changed my lawyer he after 11 year i came to know about ex-party proceeding and thereafter i filed application for set aside exparty order but court dismissed the application but in that order court said that " even otherwise defendant no.2 has a right to join the proceedings from here as merely he cannot be relegated to the position he would have occupied if he had appeared on that day but for further hearing of the suit, defendant no.2 can join the proceeding". I WANT TO KNOW WHAT RIGHT I ACCRUED AS COURT ALLOW ME TO JOIN PROCEEDING NOW THE FILED HAS BEEN PUT FOR FINAL ARGUMENTS.
the case is one in which a will deed has been challenged and my forged signature has been done by someone on the said will deed as witness. i wants to depose my witness. please guide me.
Parking space occupied illigally
I have recently bought a flat with 100 sq ft covered parking space. The parking space is properly marked in the agreement with the parking slot number. The same was there in previous 2 deeds also. The agreement was accepted by the bank and provided me a bank loan also. However, the owner of the adjacent parking is parking his car in such a way that my parking way is blocked. He has illegally park his car 20 sq feet ahead of his actual parking space. He has been doing the same thing with earlier owners also where he didn't allow them to park their car in the allocated parking space. He has already filed a complaint in local police station regarding mental harassment against earlier owner when they tried to park their car in the allocated parking space. The same was known to the society people also.
Kindly suggest how I should approach to get the parking space free. Is there any legal provision available where I can get the parking space free without getting into direct confrontation with him.
