Refund of court fees:

if the Plaintiff lost the case after depositing huge amount of court fees and does not want to pursued his case further, can he get back the fees deposited in the court by way of Court fees? What is the procedure? Can the court refused to refund?

S 163A Motor Vehicle Act

When a Claim is filed under MOTOR Vehicle Act, in case of death of boy of 27 year, not married, The claimants are parents aged about 50. The multiplier applicable is as per age of parents as it calculates less in comparison of calculation as per age of deceased. But if the case is filed UNDER SECTION 163A of MV Act age of DECEASED only is taken into consideration and no fact beyond schedule II is considered. Will anybody give me citation on this particular point? I have come to know that MFA 282/2002 decided on 20/11/2007 by the Honable Kerala High Court titled as I Damodaran v M K Valsala is direct citation on this point. Will any body help me to furnish hard or soft copy of the Judgment?

till what time period the case can be reopened/status- and how to obtain copy of the case file from the court

My father had file case in civil court for land grabing.He had purchased a plot in 1965.There after three parties claimed that they had purchased the same plot in splited manner for some other person and have got registered documents of 1982.He filed a case and one party out of court comprised with him in 1990.There after the case is pending in the court.My father coud not follow up the case due to ill health and the both ny father and his advocated are deceased. Can I reopen the case after 18 years or whether the case is still open.I have no clue to at all what has happned in the court.Is there a time limit as per law.Now there is a public notice that one person is intrested in purchasing one of the piece of the land from one of the parties.Can i reply taking objection. Or do I have to have all the papers.I have only few papers.Can the file be obtained form the court as I have the case Nos..What is the procedure to obtain copy of the case file form the court and how much time will it take.

Stamps in a vakalath in a Quasi Judicial proceedings

Is it necessary for an advocate to affix stamps and court fee in a vakalath to be filed in proceedings of a quasi judicial proceedings?

change of name

One of our employee whose wife's maiden name is Pratima Mishra after marriage she is to be called as Pratima Satpathy. Her nick name is Manini. The employee by oversight in all the employment records/nominations mentioned her name as Manini Satpathy. As per her school certificate it was Pratima Mishra. Now he submitted an affidavit sworn by his wife Pratima Satpathy before Executive Magistrate, duly notorised alongwith news paper cutting in the local daily about the change of her name as Pratima Mishra, Manini Satpathy and Pratima Satpathy are same. Can we take it on record ? What is the law relating to this please clarify. Regards

Is it legal for any authority to take disciplinary action against his subordinate officers, when an inquiry is pending against the said authority?

Motor Accidents Claims Tribunal

Injured victim filed a claim petition against the owner, driver and the insurance company of the vehicle.

On first hearing insurance company filed vakalath. driver was set exparte. Fresh summons was ordered to the owner. But steps not taken.

On subsequent hearings, since counter was not filed, insurance company was set exparte and since steps was not taken, claim against owner was dismissed.

Now matter posted for exparte evidence of the petitioner. How and from whom can the petitioner get his remedy?
