Whether theft of electricity can be assessed under section 126 of EA 2003? and whether seaprate case of recovery of the assessment can be lodged even before pending case of theft? Plz advice suitably

need expert advice to get out of a financial mess

My brother completed his higher studies in Australia, and is now having a decent job there.
One of our relatives, recently asked my brother for his bank account No. Then a person from Kuwait, transferred a large amount of money into his account, and our relative asked my brother to transfer it into another account in India. My brother innocently complied with this request. Now the person in Kuwait is demanding this money back, and threatening my brother with legal action, if he does not give the money . Kindly advice on how my brother can get out of this mess. If I can get a declaration from my relative who is known to the Kuwait party- stating that my brother has no connection with the money transfer, nor has gained financially out of it; will such a declaration help him in case of any legal problem? I would appreciate an early reply from the experts, and thanks for the same.

non compliance of consumer forum order

My client's bike was stolen and insurer repudiated my claim on the ground of non submission of required documents,my this complaint was accepted and insurer was directed to pay 20000/-Rs. but after passing the above stated order,insurer sent a latter to my client/insured and required power of attorney and latter of subrogation and also said to transfer the ownership of motorcycle in the name of co.,whereas no where it is mentioned in the order that complainant will supply above stated required documents to insurer or will transfer the ownership in the favour of insurer,now co. is again harrasing my client even are not providing formatetc for latter of subrogation etc.execution us 27 of cp act has already been filed by me and compliance period of one month has already expired.co. has send me above stated latter after expiry of period of appeal and date of compliance.kindly help

Delay in sattlement of mediclaim by insurer

My client was operated for heart problem and bills of Rs. 3 lac were submitted in the month of sep 2009 by him for reimbursement,but co./insurer(ICICI prudential)is not deciding this claim even after a period of five months and insurer has replied time and again that they are investigation the claim and awaiting for experts opinion,i want to know what is maximum period which is legally permissible to insurer for which they can
withheld/investigate and delayed my claim. thanks

e-Courts in India

What is the general feasible scope for institution of e-courts in the country? Why can't a full fledged e-courts can be instituted for Lok Adalats, DRTs, Banking Ombudsman, Consumer Courts, etc.

Live telecast of courtroom proceedings, digitized legal records, archives with audio and visual clippings of court hearings and judges dictating the orders are just a few of the resource boosters that the e-court project of the Central government has already promised. Once the system is put in place, any authorised judicial officer can replay recordings of old court proceedings by the tap of a key. The system and data will be protected with software against viruses, spam, spyware and other threats. In case the system crashes, a data recovery and back-up system will ensure records are not lost. The e-court project, said sources, will provide accurate and non-tamperable electronic recordings of court proceedings.

The system uses encryption to protect data and recordings from alteration and also to certify its authenticity. The integrated digital court recording system will have three cameras inside the courtrooms; three fixed microphones for the judge, accused and the witness boxes while the lawyers will be equipped with wireless microphones. Hi-tech courtrooms will never escape the judge’s eye as he will have an LCD monitor with a picture-in-picture facility. A wireless touch panel will allow the judge to record courtroom proceedings and also launch video conferencing with jail inmates, police and forensic experts. Plasma monitors will make the courtrooms through video conferencing should never a distant reality. Law qualified IT professionals can contribute a big way in such projects I invite our learned brethren to join this debate and post healthy suggestions

Case against Homeopath clinic

This complaint is regarding a homeopathy clinic named Nash Homeoplex located at various places in Mumbai.
I was a patient at Nash Homeoplex for the entire last year 2009.
I had joined Nash for my skin problems.

I am finding myself cheated as the ASSUARANCES of curing my skin problem given to me before the treatment are not fulfilled( not a bit ) till now even on the
completion of the treatment of one year.

Nash Homeoplex has cheated me by getting me enrolled for treatment by giving false promises and COMMITMENTS of showing the start of the results within 3 months of
enrolling after paying the entire fees.
Nash Homeoplex has not delivered a bit of the results they COMMITTED.

I want to file a case against them.
As usual they had not given their commitments in written and so they are now shedding their responsibilities claiming that they are not responsible if the
treatements does not show any improvement as they had not commited in written.

Anyway I have a voice recording( during my third visit ) of the doctor taking responsibility.
During the first visit the doctor had made tall claims and took the responsiblity which I did not recorded as I believed them as they were taking responsibility.
During my second visit I paid partial payment.
During my third visit I paid the remaining amount. At the same time I took a voice recording of the doctors satatements in which the doctor has again said that "Yes I( the doctor) had given the assuarances of curing the skin."
Can this voice recording be considered equivalent to a written assuarance and help to make my case stronger and nail nash homeo.
So anybody can please let me know how string is my case against Nash?
