Pay Hike issue

Hello,

I am from Bangalore. I am a Team Leader in an MNC. I was promoted a year back and till now I have not got my pay hike which was promised to me in 3-6 months. Some of the other co-workers have been given the hike. I would like to file a case on My Manager and my Ops Manager for more clarity and also to make sure there is written guideline amended and bound after the Court of Law directs these companies to do the same for future employees. I am very disappointed to report that good, honest and hardworking people exploited every day.

Free SIM cards

It has now become a permanent practice that many service providers are marketing free SIM cards to lure the general public to become their customers in this competitive environment. Many overlook even obtaining bonafide identity of the subscribers. Later on this number is disclosed to many business people and time and again business SMS messages galore. This unfair practice is not controlled by any legislation. Government is yet to come forward to take any measures to address this issue. Let our eminent legal intellectuals join this debate and post their feedback to this issue.

RTI REPLY SHOWS FABRICATION OF FACTS AT WBHRC LEVEL

THE SYNOPSIS: MY HOUSE IN KOLKATA IS BRUGLED THREE TIMES (26/08/2009, 30/08/2009 AND 27/11/2009). THREE FIR AND PAINSTAKING VISITS OF ALL HIGHER OFFICIALS IS THE CREDITS.

AS I HAD ALREADY GIVEN A PETITION OF INACTION OF POICE TO THE WB HUMAN RIGHTS COMMISSION. I SHOOTD AN RTI ON WBHRC ON 03/03/2009 FOR WHICH THE REPLY I GOT IS THAT THEY AHD CONSTITUTED A BENCH OF A MEMBER OF WBHRC ON 04/11/2009 WHO GAVE A NOTICE TO THE DY. COMMISSIONER WITH 3 WEEKS TIME LIMIT. THIS COMMUNICATION TO MY WIFE AND THE REPLY REPLY ALSO HAD THE COPY OF THIS INTIMATION REACHED TO ME AND WIFE ON THE SAME DAY ON 18/03/2010 ALONG WITH MY RTI REPLY.

THIS FABRICATION OF FACTS IS VERY CLEAR THAT THE WBHRC HAD FAILED TO CONSIDER AND ACT UPON THE PETITION DATED 23/09/2009 AND HUSSLED UP AND GAVE A FAULTY REPLY. NOW AS THE STATE INFORMATION COMMISSION WHOIS THE AUTHORITY OF RTI IN WEST BENGAL AND THE WBHRC ARE OFFICED IN THE SAM BUILDING AND SAME FLOOR, THE POSSIBILITY OF FURHTER FABRICATING AND GOING HAND IN HAND WITH THE STATE POLICE FORCE IS VISIBLE AND MORE VIABLE.

IF THE HRC WHO IS WESTED WITH SUO MOT POWER TO ORDER FOR CID/CBI INQUIRY, GOOF-UP LIKE THIS, WHERE WILL THE LAY ABIDING/TAX PAYING/TRUE CITIZEN GO FOR RESCUE.

I HUMBLY WISH TO MENTION IN THIS CONTEXT THAT MY WIFE'S FAMILY IS HAVING LINK WITH LEADER/STATESMEN LIKE THE FIRST PRESIDENT OF INDIAN NATIONAL CONGRESS, WOMESH. CHANDRA. BONNERJEE.

Uniform Vehicle Tax

LAW NEWS :

The Centre plans to invoke a constitutional provision to end the wide disparity and diversity of motor vehicle taxes across the states. The idea is ensure that sundry taxes and levies on vehicles, including excise duty, road tax, registration charges and toll tax for plying on specified roads, are rationalised and made uniform across the country. Currently, state-level taxes on vehicles vary widely not in terms of rates but also in their application. The rate of road tax ranges between 4% and 15% of the excise-borne retail price of the vehicles. While some states levy a lifelong road tax, annual levies prevail in others. Then there are other imposts like parking charges imposed by states like Delhi. The vehicle owner is also required to pay toll charges to operators of specified stretches of roads, as fixed by the National Highways Authority of India or state-level authorities. Currently, motor vehicle taxation is a state subject and the central government can only be an advisor in the matter. Although the Centre has been insisting on certain uniformity in motor vehicle taxes, the states have mostly ignored it, in the absence of a legal provision. The Centre is now considering making it mandatory for states to heed its advice in this regard. Road transport and highways secretary Brahm Dutt told FE: “Under the Constitution, the Centre is empowered to advise states on motor vehicle tax. This is in the Union list in the Constitution. We are finalising the guidelines and putting it in the form of an Act so that there is uniformity in these taxes.” Stating that making vehicle taxes uniform is the Centre’s “responsibility,” Dutt said this would go a long way in ensuring seamless travel and would boost the economy. He said the road ministry has asked the S Sundar committee to look into the issue and give its recommendations. The committee was set up last year to suggest suitable changes in the Motor Vehicle Act, 1988. The committee is expected to submit its report before the monsoon session of Parliament. Most states impose a one-time tax on motor vehicles for a fixed period of time. This tax depends on whether the vehicle is for transportation or other purposes. Toll charges are fixed by the road authorities on the basis of distance covered and the type of vehicles. “The power (of formulating mandatory norms on vehicle taxes) has not been used by the Centre so far..
