JOINT HOLDER IN PROPERTY- RIGHTS

What are the rights of a non-contributing joint-holder in immoveable property- on the demise of the first holder does the joint-holder automatically become the owner?
What are the liabilities if any of the joint holder under Gift Tax Act? Will it be considered a gift and become taxable?

Name Transfer

A property is in the name of 'X'. He was having one son-'Y' and 3 female issues. After the death of 'X', it was not transferred to his son - 'Y's name.

'Y' was not having issues. 'Y' died and 'Z' was adopted as legal heir and Adoption certificate is available. 'Z' performed last rites for 'Y'. It is more than 50 years. Till date the property is in the name of the 'X' only.

What is the procedure to transfer the property in the name of adopted son - 'Z'.

Share in co owned flats.

I am one of the legal heir and have 20% share in the two flats of my late father. In spite of an order passed under Consent Term in 2009 other legal heirs are not comming forward to sell off the flats so that I can get my money I therefore need an advocate from City Civil Court at Dindosh, Goregaon-E for appointing Executor. Pl. also advice tax implications if I invest money received from these flats in buying a resi. flat as I do not own any residential flat in Mumbai.

shop vacate

My father had rented a shop on basis of rent reciept 15yrs ago.now I want to vacate my shop from the tenant.My father had passed away & I am alone & unemployed.Is their any way to vacate my shop & my house is in poor condition, needs reconstruction badly.I want to construct it after the tenant is gone.
Plz help me out.

unregistered will and legal claim

Sir, My Father has 5 brothers and 2 sisters.My grandfather died with an unregistered will leaving assets on my fathers and other brothers name.The land my grandfather gave to my father was booked on my grandfathers name but all installments were paid by my father right from begining and the land ( we have made a house on that land ) is now a free hold hand and is on my fathers name . One of my fathers sister claims that she wants a portion of property. we are a hindu family.What can we do to stand up our case.The land is in my fathers name and all papers are in order.please suggest.All brothers and sisters have signed the unregistered will except one sister who claims the right now. please help.

Encroachment of Passage

Respected Lawyers,

My aunt has a piece of land in her village; The same village is governed by Town Panchayat. The land is classified as punja and has no passage since the entry part of the land has three small encroachments of huts. The encroachments were made on Poramboke land and partially in my aunts place too. Further they are living in the huts for more than 30 years. Being the same is classified under road poramboke the encroachers have not given Patta as per the Tamil Nadu Govt. Order.

We have no access from any angle to get into the land. So we sent a letter from through our advocate on 1/8/2010 to The Exec. Officer, Town Panchayat/The President, Town Panchayat/The Tahsildhar/The District Collector stating that we have no access from any angle to get into the land and also the encroacher are causing nuisance to adjacent school going girl students in the view of getting directions from Honorable High Court.

We have received a reply on 04/10/2010 that encroacher who live there doesn't create any nuisance further there is no hindrance to the complainant. Also whenever the same poromboke land requires to panchayat, they will vacate the same with the help of revenue and police officials.

The reply from the EO is totally false ie., not even a single foot of passage access is available. The only reason behind those statements is the encroachers are close relative of President and they have rented the huts and causing nuisance to us.

How to prove the false statement of EO legally?
Who is the competent authority to certify that there is no passage access ?
How to get the encroacher evicted?
Please guide us on the same.

meaning of "interest" in immovable property

Dear ld. members,

One of the difference between lease deed and leave & license deed is that "an interest" in not transfer in leave & license deed while the same is transferred in case of lease deed.

My question:

What is the meaning of "interest" in immovable property?

So that I can say see this interest not being transferred in case of eave & license deed while the same is being transferred in case of lease deed.

Wrong PAN No. in the Sale Deed

In a sale deed, the PAN NO. of the buyer is wrongly mentioned. Is it a material error?
Can any thing be done about it?

LAND GRABBING

I do have a query reg land fraud .
Actually one of my client had purchased a site from a landlord through Land Developers with registered sale deed. i.e in 1995. Since then he has been paying tax regularly in his name and khata is in his name all pucca documents. In 2007 a third person who is in any way related to the client sold property by creating false POA (as if my client had given power of attorney to sell the site to that person by creating forge signature of my client) and got it registered. The above said transaction came to know to my client last year. Actually my client has changed residence in 2000 and also in the original sale deed which my client got registered in 1995, doesnot bear my clients signature and also in subregistrar office. My clent tried to give a complaint to the local police station but police denied and argued with my client that original sale deed doesnot bear the signature of my client and refused to take complaint and indeed asked to give the original sale deed to the police and they would look into it without booking any FIR. and my client put the fence and also a board bearing his ownership 2 years back. and gave a stay application to gram panchayat,tahasildar office not to transfer khata. Now my client wants his case to be settled faster. what is the solution. If he wants to cancel the forged sale deed then what is the easiest method.
