I have purchased 2 consecutive plots in BMRDA approved layout.Although layout is BMRDA approved ,khata of all the property is with panchayat.Now I want to construct building on these plots.is it sufficient to convert 2 khatas to single khata from panchayat and get plan approved from them.OR do I need to get amalgamation done in BBMP and also plan appproved from them.Please note that all other villas have got plan approved from panchayat only.

Dear All,
A son has given a general power of attorney in the year 2002 to his parents.
The mother is now purchasing a flat in a co-perative society in her name and her son's name. She is using the said power of Attorney where her husband is signing on behalf of her son. She has no document to prove that her son has consented to the said purchase. In the said poa there is a general clause of purchase of a flat. the said POA is not registered nor does it have any photographs or thumb impression.
What is the validity of such POA. Can such POA be taken up at the time of registration??
Please help its very urgent.
Do we need to take a specific POA from the son in favour of the father??
Very urgent. Need the guidance of all experts.

Hi,
I have been staying for 3+ years in a Rented flat with LL agreement which we renew and register every 11 months. My question:
1. Who is responsible for renewal registration+ stamp (franking): tenant or landlord?
2. What happens to tenant/landlord rights if the agreement expires due to efflux of time but rent is being paid on time every month and both landlord/tenant wish to continue arrangements without renewal?

There was a property given for development to builder using notory document (having schedule for payment and 18% interest to be paid in case deal does not complete in 18 months) and registered irrevocable power of attorney which did not have payment terms.
Later builder could not complete payments as per schedule but still he has transferred land on his name based irrevocable power of attorney from collector office. Although he has made payments (without interest) but it took 10 years against agreed 18 months.
Sale deed did not happen for the same but builder has transfered land to third party (organisation) based on irrevocable registered power of attorney(no mention of payments). Can I cancel the power of attorney which irrevocable after 10 years now and ask land property back as payment did not happen in time and meanwhile property rates have changed in multifold OR can I ask for interest which builder has not yet paid.

I share inherited residential property in Chennai with my brother. We mutually agree to gift my share by a deed and he paying nearer market value in cheque. Is to transfer attracting stamp duty under property transfer at market rate for the property as also capital gains tax under IT. The property is about 55 years old

In our society of 28 members, the Managing Committe was formed without any elections and the committee members have not furnished any Personal Liability Bond as per Society Bye Laws.
In the last 2 years the society charges have been more than doubled from Rs.600 per month to Rs.1300 per month but this money was never spent to repair and maintian the building.
Structural Audit report for the 35 year olf building states that it is in urgent need of strcutural repairs but does not say that it is dilapitated or beyond repair altogether.
The Managing Committee keeps having AGM in which redevolpment issues are discussed stating that more than 70% of the 28 nos members have agreed and that the minority members will be forcibly evicted by the builder.
The society is on collectors land and not a free hold land and each committee member brings in the builder of his choice for negotiations.
Can the minority members approach the Registarr of Societies to request for appointmnet of administrator who will at least mainatin the society in good condition and not willfully allow for the deterioration of the society as witnessed over the last 3 years with a vested interest to go in for society redevelopment as per the powerful lobby of the economically well to do members.

My Flat purchased is in a Cooperative Housing Society located on Collectors land in Santacruz West Mumbai. I have paid full stamp duty and have already the Share Certificate in my name from the CHS signed by Chairman & Secretary.Now we have been advised to pay a fees to Collectors Office for transferring the flat in my name in the Collectors Land Records.
Kindly advise if this fee is valid and the amount that must be paid for a flat having 640 square feet carpet area.

If Mr Ramaiah is executed sale deed on behalf of a Trust, is it compulsory to obtain a copy of the Trust deed and study powers of the trust to sell the property and also Resolution passed by the Trustee authorising Mr. Ramaiah to execute the sale deed on behalf of the trust.
If the trnsaction was done on 12.3.1997
since it is more than 12 years we need not insist--says the seller. Law governing company and TRust are different. Comment please. What risk is purchasing such property without those documents??

Thanks for the your valuable advice .How long it will take to get legal heir certificate should we need pay any duty for the same. it is mandatory to get one ,just partion deed will not serve the propose.

my query is as follows :
A pvt. ltd. Co. is giving loan of rs.35 lacs to its employee or third person against
deposit of tiltle deeds of property which the person is going to buy...
Mortgae deed drafted ....now for stamp duty & registration which
documents are required ??
As concerned person appointed for registration is asking for
RBI approval letter....??
why should pvt.Co. take approval from RBI ....regarding giving loan to its employee?
No loan is taken from bank ?
