Block the property from being sold by step mother

Background -
My parents had separated legally somewhere in 1990,

my father later remarried somewhere in 2000.

He did not have children from this wedlock.
My father expired in April 2014.

Current scenario -

There is no will that he has left behind.
I have no clue of what he has left behind except for a House.

I have NO intentions of troubling my Step mother in terms of getting a share in the wealth my father has left behind.

However my concern is that after Step mother passes away whatever is left behind should not go into wrong hands, expected miscreants are - her sister and her brother in law.

Question -
What legal options do i have to avoid - The property being sold out either by Step mother OR illegal occupancy after her death by her relatives.

Registration of a flat in favour of single name

Respected Sir,
I have got a home loan from a bank for buying a flat in an apartment.

According to the TRIPARTITE AGREEMENT The builder is the first party. Bank is the financing authority. As borrower my wife is the applicant and I am the co-applicant.

By the bank records I am an applicant(employed) and my wife (house-wife) is a co- applicant. About 80% of the loan has been disbursed to the builder. The flat has not been registered till now.

Now the circumstances have been changed. Because of some unavoidable reasons both of us have decided by an affidavit to get the flat registered in favour of single name (main applicant as bank records and co-applicant as agreement).

Deciding above I met the builder and the bank officials. The builder stated orally that the above said can be implemented if the bank has no objection but the bank refused to do so.They say that the TRIPARTITE AGREEMENT can never be changed because the loan has been disbursed.

Now I want to know that-
1. What is the process to get the flat registered in my single name?
2. What should I do?
Yours Faithfully
Kamlesh

Hindu succession act

Will some one please explain the below interpretation in simple language -
"where a Hindu dies after the commencement of The Hindu Succession (Amendment) Act of 2005, his interest in the property of a Joint Hindu Family governed by the Mitakshara Law, shall devolve by testamentary or intestate succession under the Act and not by survivorship, and the coparcenary property shall be deemed to have been divided as if a partition had taken place."

Release deed signed by my mother without her knowledge

Dear respected Lawyers:

My mother has signed to a registered copy of inherited property release deed to her brothers, in that there is no mention of property of her father's mentioned in that release deed and it has been signed by her with high-pressure and with stress from them after speaking to them in mutual that they will give one acre of land out of 50 acres of land and this was not mentioned in the release deed, but after two years of release deed. They are not talking about giving the one acre land to my mother as it is not mentioned in the registered release deed and they cheating her. Please tell us what to do and we have approached the court and what rules to be followed. Please help us as my mother is fully depressed about her brothers' way of gesture towards her. They are not talking to her and not inviting to her to any functions, it is okay that is not bothered about the function but they cheated her by not giving the one acre of land out of 50 acres of land as they have talked earlier before registering the release deed.

Nhai act & land aquisition act 2013

Respected experts,

If NHAI acquires new land for its road widening projects (say, as of today), does recent Land Acquisition Act 2013 applies to it?
We learnt about the fair compensation for acquired rural land under Land Acquisition Act 2013, and are wondering if the same applies to rural land acquired under NHAI act 1956 now?
Thanks in advance.

Seeking refund from builder : unitech noida/ delhi

My name is Virendra Verma, currently residing in Delhi. I had booked a 2 BHK flat in Unitech Unihomes-3 in sector-113 Noida in June - 2013. As per builder buyer agreement, it is agreed that Unitech will deliver the flat by June- 2015 (i.e. 36 months from agreement date). Sadly, Unitech has been cheating with me and have not completed even ground floor of the said building. It is highly unlikely that I will get possession of the booked flat by the agreed date.
I want Unitech Ltd to refund paid amount by 18% interest compounded quarterly (the same rate which they had forced on me when I had delayed one installment).
Can I ask for it before completing the period of 36 months? If yes, Please help me.

Easement rights

landlord's Land is leased to Company to run a petrol pump. The dealer running the petrol pump on behalf of the corporate takes on lease, some land at the back of leased land and uses the leased land (as taken by company) for accessing the back portion land.

On vacation of land by the company under orders from the Courts on giving undertaking to the Court to give peaceful and vacant possession of the premises -

1. The dealer files claim of easement - is it maintainable or not.

2. Can company be tried for contempt of court as the land has encumbrances which were allowed during lease ? Can connivance of company and dealer be basis of contempt ?

3. Can compensation be enforced on company if landlord has to part with some land ?
