Purchase of property

Hello sirs,
I want purchase an apartment in bandlaguda, hyderabad, telangana state. the owner of the property resides in the U.S.A. i.e., an NRI. At the time of purchase of this property, he was not able to present in person for registration process to purchase the property but purchased the property through power of attorney in the name of his representative i.e., his father. And now also he is not able to come to India to sell this property but wants to sell this property through power of attorney in the name of his representative i.e.,again it is his father. Is it safe for me to purchase through power of attorney? Is it legally valid throughout the generations to come in future? otherwise what are the other ways to purchase?
thanking you,

buying property based on affidavit

I intend to buy a residential plot in Bangalore. Pls advise regarding buying below property.

One of the seller inherited property from his father through affidavit signed by all of his brothers who relinquished thier right on property. Based on affidavit, mutation /khatha is already changed in the name of seller but as per EC, still his grandfather name is appearing.

The seller father is the only child of his grandfather as per affidavit who bought this property from another seller during 1955..

Pls advise regarding buying this property.

Purchase of property

Dear Sir

I intend to purchase a residential house constructed on 90 Sq. Yds of land, presently under GHMC Limits. The seller of the property is in possession of that property since last 15 years which he aquired through an notarised agreement of sale in year 1998. subsequently made some additional constructions on it got it assessed in his name and is paying the property tax since last more than 13 years.

Is it safe to purchase the same basis his continuous peaceful possession, as he will not be having any registered link documents except property tax receipts and electricity bill in his name since last 15-16 years. I understand the notarised agreement of sale by which he purchased the property and was put is possession is of not use.

Please advise.

Residential apartment ownership

I have a Residential apartment in Mumbai with me as First holder and my Father and wife as second and third holders. My father invested 47% of the amount and the remaining portion was funded through my saings and a loan raised from housing finance co. What is the procedure for transmission of the flat ownership after my father's death(He is still alive)?
His share was made through sale proceeds of another flat which was acquired through his self earnings.
Is a will only sufficient or NOC of other legal heirs, viz. my two brothers also required?
Also can he nominate and will his share to my son ?

Partition claim wholly - maintainable ?

Dear Experts Please answer my query,

A Hindu family consists of a Father and 2 son, father died leaving a "will" of his "self-accrued" house to his elder son alone. Now elder son filed a "suit for partition" claiming whole house under the will.He says younger son not having any share in house.

Query:

1. Is the "suit for partition" claiming "wholly" under will is maintainable or he have to file suit for declaration?

Sale value exceeds 4 times of the guideline value

I have a Residential house and i am planning to sell it for almost 1 Crore .
But its govt guideline value is only 26 lakhs .

I have approached the Reg dept and asked whether it is applicable to register the property for 1 crore. He told even though its a govt rule to register for the actual sale value,he wont allow me to register for one crore, since it will increase the guideline value for that area.

This is a problem for him since he is going to answer this in the future audits/enquiry .(all Deviations in the registrations will need to be answered in the future audits).

That is a problem for others who are coming for the registration in that area.

Also if i stick on my point ,i may get problem from the local peoples of that area regarding the same .(cos i will increase the guideline value).

All these points are all told by him in offline.

These are the problems i am facing .

But still i want to be a good indian Citizen .

I want to pay the income tax whichever it is 20 % or 30 % .

Now my question arises .

1) I want to be clean .How to make a clean Transaction?

2) if i get two cheque's for 25 lakhs and 75 lakhs and paying Capital gain tax (20 %) for 25 lakhs and normal income tax 30 % for that 75 lakhs ..is that ok??

3) Do Govt will ask question abt that 75 lakhs ??

4) or it will create any problem for me or to the buyer??

I dont want put buyer in problem too..

I wanna to be clean always. Please suggest me a way to sell my property.

Fake rent receipts for electric bill transfer

Dear Sir,

I am owner of a cessed property and one of the relatives of my tenant/occupant has used fake rent receipts with my forged signatures to transfer electric bill on his name. I have a suit pending against him in small causes court and as such no rent receipts have been issued to him as he pays rent directly in court. I have procured documents under RTI. Can you advise me what action can I take against him?

Regards
Jugal
