Harrasment by neighbour on parking issue.

Dear Advocates,
Please accept greetings by my side.
I need your valuable guidance in the below matter:
1) My uncle who lives in a multistoried apt. owns 07 stilt parking space covered by patra in the roof. The parking space was purchased by my uncle from the developers and it is significant to note that the electrcity meters of bldg. flats are randomly installed in the said parking spaces since inception.
2) It is clear that as the parking space owned by my uncle he has full right to install to arrange for safety of the said parking spaces.
3) A few days ago my uncle had started work of affixing iron grills in the said parking as to prevent any mishap due to Electricity meters but his one of his neighbour who is also a local self proclaimed leader of area has came there and created a huge scene by obstructing my uncle from installing the grills as the parking space has become a public property because of electricity meters.
4) In addition to this he also filed complaints at municipality and police station and police and municipal employees have visited at my uncles flat but after I have showed them all the papers they returned at the same time.
5) Sir, still the neighbour is constantly planning new strategies to harrass my uncle only to satisfy his ego. He even had said that "I will make you to touch my feet" my uncle is layman and therefore I request you to provide remedy in this matter.

How share is calculated in ancestral land with a building?

Land is ancestral for "GG (great grandfather)". GG built a building on this land with 12 flats out of which 3 were sold to strangers between 1965-1975. 6 flats came to share of 6 sons of GG(1 flat to each son). In rest of the 3 flats each son has 1/6th share.

The 3 flats which were sold to strangers by GG were again sold to new strangers between 2004-2009.

Now my questions are as follows:

1) Can a great grandson of GG born in 2002 reclaim share in any of these 3 flats which are now owned by strangers? (grandson of one of the son of GG)

2) How is the share in the land only (not building) calculated for the 6 sons of GG?

3)Do the strangers who own 3 flats out of 12 own share in the land as well?

Thanks

Jaya

Hindu succession act

When the Class I heirs are alive, and the names of Class II heirs came on records (7/12, 6A etc) before the names of class I heirs then
(1) is there a need to follow procedure first to include the names of class I heirs before deleting the names of class II heirs?

or

(2) can the application to includes the names of class I heirs and deleting the names of class II heirs can be filed simultaneously
[ the names of abovementioned class II heirs came on record after the death of their mother who was the class I heir]

(3) what is the limitation period to delete the names of class II heirs from the date of their inclusion on the records?

(4) what will be the procedures when the names of class II heirs came on record before class I heirs, how to remove it ?
what is the solution if class II heirs objecting the inclusion of names of class I heirs because their names first appeared on record and took objections against the said class I heirs before talathi and circle officer?

Expecting your earliest reply.

Thanks in advance

Sharing property right with father

1. I have a self acquired flat (lease hold) in Greater Noida, taken possession in 2010 and registry done in 2011.
2. In 2007 I had taken a loan of 15 lakh for 15 years and the EMI commenced immediately and till date 80 instalments have been paid and balance are 100.
3. My father retired in 2000 from a PSU without any property and neither does he have any ancestral land/ property being a refugee post partition (1947).
4. His only investments are his children and we value his sentiments. Hence, we included his name in during the registry of our flat.
5. I have one younger brother and a younger sister (both married) who do not have any problem and see this as our gratitude to our parents.
6. However the loaning agency has now in 2012 raised objection to his being included in the registration and are asking for a gift deed or relinquishment deed in my favour to avoid problem in future.
7. My loan is insured and I have assured the loaning company that I can provide a registered will from father if required but a gift deed will unnecessary complicate matters and vitiate sentiments.
8. They do not agree . What is the way out.

Legal value of cadastral survey r.o.r

There was A,B & C three brothers, in the year1933,1935 & 1936 in three different cases through a civil court judgement A & C was declared bankrupt and their property was publicly auction by court at that time. With several outsiders B brother also purchased some part of that auction property at that time. After that it was recorded in the RSROR in the year 1956 and presently the LR records are also in the name of the purchasers name.
Now after 80 Yrs grandsons of A has file a civil suit with only one document cadastral survey (CSROR) paper that the said auction property was the property of a Deity as per CSROR,so the auction was illegal and void. They have not submitted any Title Deed or any other documents.if that was a property of Deity, how a civil court at that time in 3 different cases publicly auction that property. Please let me know what is the legal validity of CSROR as per civil/ property law and reference of rulings of Supreme court or High courts in this regard.
With regards,
somen mitra
