the government property measuring 40EW x 60 NS was allotted to owner from Sanitary board in 1985.
the land owner then sold this property to two people(owner1 & owner2).
owner1 got property with dimension (40 EW x 25 NS) same mentioned in sale deed registered in 1987.
Owner2 got property with dimension (40 EW x 25 NS). the rest 10 feet NS is left to road and used as road by owner2.
But in sale deed of owner2 he got registered as (45 EW x 25 NS) in 1992. He over occupied 5 feet out of 10 feet road present in East side.
Now owner1 is left with only 5 feet road for his house on east side.
Since it was a dead end owner1 has utilised east side 10 feet road for storage area.
Now owner2 who had occupied 5 feet below, and now is going for complete 10 feet road utilisation in the first floor.
I being owner1 can i file case on owner2 to release 10 feet road occupied by him. Since it was dead end i have utilised the road which i am ready to release and demolish my storage construction.
Now to file a case i have kata extract of original property (40x60) from sanitary board and plan approval for original property(40x60) in which it has clear demarcation of roads. apart from this i dont have any other mother deed or allotment letter from sanitary borad.
Can you please suggest whether i can file a case against owner2 now. Since the registrations happened 22 yrs back will the case still hold good?
if i can file a case what are the necessary documents needed.please suggest

Dear Experts,
My father bought flat in thane and got possession in 2005 after paying whole amount(white+black). After few months or years when society was formed share certificates were issued to all. My father's signature was taken on issue of share certificate and nominee registration. Few years back when my father retired, he could not find the share certificates. He made application to society to issue duplicate copy of certificates.
After wasting couple of months now society says, builder have objection in issuing the certificates. According to society letter, builder is demanding extra black money.
This is pure cheat by builder, if we had kept his money then would builder allowed us to stay till date without any communication from his side. After 10 years he is demanding extra black money to issue duplicate certificates. Above demand in his letter to society is causing defamation of my parents.
Now what to do and whom to approach to get our share certificate and complain against builder.
please help,
thank you,

Dear Sir,
I requesting you expert's to please clarify the below issue.
I have a threat from my aunty she is a sister of my father.
My father and my aunty are the 2 children's to my grandpa's.
Issue is we have given 1.24acre land as a gift to her and in 80's my grand father purchased 10-15acre land and registered on her name. Now we have only 4acre land and we have 3children's to my father.
But there's no partition deed or court decree, so my aunty want to misuse this and she planning to claim another share. Can she be able to succeed.
Please tell me she born before 17 june 1956
...is she eligible.
I saw in website that those women born before 17th June 1956 are not eligible to claim property share, is that true.
Please help me, with your valuable thought's.
Thanks@Regards,

My father died without writing a will and he had promised that the house we reside will come to me. He had already contributed quite a lot of money to my sister to build her house which was around twenty years ago but there is no proof for it as he had paid cash and no receipt was taken. There is some money kept in fixed deposit which will be given to her after my mom breathes her last and land in native place which was purchased by dad two-third share of the property is already given to her. As there is no will return by dad the flat where I am staying is divided among three people, sister, mom and me. My mom have already gifted me her share of the flat to me by a registered gift deed (as per last wishes of my father). so I am the two- third owner and my sister is one third owner, In the society and share certificate, my mom is absolute owner of the flat. My mom has not disclosed to my sister about the gift deed. My sister is now insisting that she wants 50 percent share of the flat. She is not willing to settle for anthing less. She and her husband had fought with me for this. Now they are keeping quiet as mom will be affected by this but after her death certainly she will fights or have legal tussle for the property. My sister is well off monetarily, they have a 2 BHK flat at Powai and I am without any flat of my own. I don't want to have any fight and also get my two third share of the flat. Can you please let me know if the registered gift deed can be challenged in court, if challenged, whose favour will it be in. Can any memorandum of understanding can be made my mom and ask my sister to sign that she will not go to court for the property.
Please advise what best to do.

A member of society is not allowed to apply for assessment of property tax to MCGM although there is such provision In law for individual assessment of PT
In fact society is in control of cheats indulging in taking away lacs of rupees under the pretext of bribes to MCGM for the illegal work without taking consent of members. Now the queries are as under:
1) Can the member approach Consumer Court?
2) Can society charge higher amount for PT even after 15% reduction by MCGM since April 2010 ?
