Peculiar 10years old land dispute

Sir,

Please go through below completely, it is a long pending peculiar case having multi dimensions.

I am from Warangal, Telangana (earlier Andhra Pradesh), my query is: In 1987 Mr.Rayapu Reddy has made a layout of 70 plots and sold to different people. Mr.Rayapu Reddy expired in 1990. In 2002 Mr.Papi Reddy & 3 others (Brothers of Mr.Rayapu Reddy), claimed said land was their part of share from his father and sold to a developer. Developer re-developed the layout as per DTCP norms and got approval from district urban development authority(KUDA) and sold to different persons in 2009. Some plots mortgaged to KUDA towards developments in layout. Plot purchasers from Mr.Rayapu Reddy moved to court making respondents as other 4 brothers, KUDA & developer. In this critical document is partition between all 5 brothers. Two partition documents existing, one in support of Mr.Rayapu Reddy and another in support of other 4 brothers, hence this case/issue is long pending. Even though developments were made in the sanctioned layout, because of pending case against title KUDA not released the mortgaged plots. Developer managed buyers of old layout by giving some money and sold all new layout plots. Some buyers constructed houses also. Without knowing all these things, I purchased a plot from developer. Now, old layout buyers make nuisance at layout saying total layout land belongs to them, developer sold all the plots, hence he won’t responds. There is no unity between present (purchased from developer) plot owners. I spoke with developer, he said, he developed and sold plots legally with all supporting documents. Please suggest how I have to proceed.

1. Whether with all link documents, am I, able to approach court, how much time it will take, since other case is pending for more than 10 years, what is the probability of success.
2. How to get back my money from developer
3. Previous layout plot owners ready for compromise by taking some amount(around 25% of present market value), as a individual how I can regularise this, since as per previous layout my plot area was of part of 3 different plots and road. There is no similarity/link between old and new layout. New layout is entirely re-designed by making new roads and disturbing earlier boundaries.
4. If all the new layout owners decided to compromise with old layout owners, how documents has to be made, since there is a pending court case against KUDA and other government bodies were respondents. Also some plots mortgaged to KUDA, they need to be released for settlement.

Thanks for spending your valuable time for reading above, request you to give your advice.

Damage to compound by neighbour

hello sir,

my name is GB alagwadi, i am from hubli in karnataka. one of my neighbour after constructing his house raised surrounding ground level upto 4 feet by putting waste soil on his side of the plot without consturcting any compound on my compound side and later a toilet was built on that raised bed without leaving any space between my compound and his toilet and after that he started gardening by leaving 2 feet space next to my compound on that raised bed.

now the problem is he is doing this intentionally (he built compound on three sides except next to my compound) saying that he has "right" on his side of the wall . my fear is by putting waste soil next to my compound made it weak and now toilet and pouring water to plants weakened it furether and within 1 or 2 monsoon rain my compound will fall.

when he didnt listened to me i called police (unfortunately he was not at home, his daughter was there and told she will tell him) but he still not stopped pouring water but the question is can he have the right to damage my compound which is built on my area ? .if it is common wall he didnt gave any money for me whole compound was built by me only and neither took any permission from me.

so what is the legal solution for this person ? which ipc and sections can be put on him and i want him to pay the damage which he did to my compound and all the emotional torture all these days. any option to remove his toilet to be removed and stop his garden ?

please suggest.

Transfer of residential property in mumbai

Hi,

I was hoping to get some legal advice on Transfer of Residential Property in Mumbai.

(Q1) In case of a sale to an unrelated party (no blood relation or any thing like that), what are the documents to be submitted to the Co-operative Society for the NOC ? Is it the responsibility of the transferor or the transferee to get the NOC from the society?

(Q2)Is society NOC compulsory for registration of the transfer?

(Q3) When do the transfer charges have to be paid to the Society? Is it when NOC is issued or when transfer deed is registered?

Thanks in advance!

Road used in my farm land by others

I have 5 Acre land in Karnataka, touching to highway. When I purchased land 4 years back, land owner said the road at one side of farm is our property. So as buffallows and other animals are damaging corps, i put a fabricated gate on its entry. Though I told other survey number peoples behind my farm land that you can use the road but should keep gate always closed then also they have made police complaint against me and damaged the gate saying that the road gate should be open always and should be removed. I think they want this road permenently for their use.

My question is whether there is any law OR procedure to get order against these peoples.

Dobule registry

Hello Sir,
My friend bought a plot by lady in 2012 and got mutation done, before buying that plot he check the papers and mutation which was on that lady name and she bought that Plot from a farmer, everything was in order.
Now he came to know that property was sold to a society in 1991 by the farmer, there after society did plotting on it and sold it out to X parties.
Now the X person who bought the same plot in 1991 showed up and claiming on it, although he do not have mutation for the same.
Please guide how we start the case taking under consideration that property was bought for 25 lkh and in registry he mention circle rate at the time 10 lkh only.

He did consult with lawyers in Lucknow and came to know that old registry which was done in 1991 is stronger and valuable than new one regardless even if he has mutation done. Court will accept old one and might reject new one which is done in 2012.
Kind Regards,
Aftab
