Transfer of flat in a registered co op society

My father who is deceased was the owner of a flat in a co op soc. In his so called registered will, he willed the flat to two(out of five) of his children and a grand child and left no share for two other children. The executor of the will who is also one of the transferees of the flat as per the will, wanted to get the flat registered in his name. The lawyer of the society has asked the transferee to provide to the society the consent/NOC of all the legal heirs of the transferor including those who have not been given any share in the flat in the will.

Is this requirement of the society's lawyer mandatory without which the flat cannot be transferred to the transferee. Please enlighten me. Thanks

On roof top of a 50 yrs three story house Under the garb of temporary shed a fabricated shed with bath room and tiled flooring and AC fitted room has been constructed without MCD approval. The mounty on the staircase way to to roof is used as kitchen. With water and electricity connection obtained illegally roof where no dwelling space was available is now shown as residential floor.
Is it legally permitted ? In case MCD is helping in the illegal venture how to haul it up for removal of the structure?
Whats is the remedial action available to the other occupants of the building who have been denied access/ facing inconvenience to reach out to their water tanks located at the roof?

Transfer of common areas to the local authority

Transfer of Common Areas in a common interest development to the Local Authority is primarily to ensure that the builder do not encroach and construct unauthorized structures n common areas.
Can the Local Authority insist on transfer of common areas for free and then insists of leasing back to the owners at a very high lease amount.
Nominal lease amount of Rs 1 or so is understandable, but leasing for many hundreds of lakhs back to owners seems unjust. This is tantamount to unjust enrichment of local bodies for free!
Can any one weigh in on the legal aspect of this?

What is the status of a pending deed.

Dear Sirs/ Madam,

As you know that earlier it was possible to register a deed, without payment of exact stamp duty and registration charge, in that case those deed a called as pending deed and you cannot obtain a certified copy of the same.

Now, my question is this whether these deeds do come under the purview of valid registered deeds, if yes, then are they treated as lawfully executed by the seller and admissible under the evidence act.

If not then the purchaser is treated how and what is the terminology for him if he is not holding possession of the purchased property.

Kindly advice.
