My father who is deceased was the owner of a flat in a co op soc. In his so called registered will, he willed the flat to two(out of five) of his children and a grand child and left no share for two other children.The executor of the will who is also one of the transferees of the flat as per the will,wanted to get the flat registered in his name. The lawyer of the society has asked the transferee to provide to the society the consent/NOC of all the legal heirs of the transferor including those who have not been given any share in the flat in the will.
Is this requirement of the society's lawyer mandatory without which the flat cannot be transferred to the transferee.Please enlighten me. Thanks
