Joint ownership of property

I have a joint property in jaipur with my brother, we have a flat with 4 rooms, common drawing and dining with kitchen on the 4th floor. our flat is measuring 3800 sq. ft area including roof and penta house ( one room with WC ). Moreover , we have a office at ground floor( 700 sq ft) , one room and WC in the basement( 350 sq ft) along with big hall ( 1200 sq ft).The ground office is in the possession of my daughter where as basement room, wc and big hall is in the possession of my brother where his son in law is operating his business of wooden work. The upper portion flat was being used jointly by me and my brother upto year 2007, but then my wife transferred to ahmedabad and we both lived there there upto 2014, but now my brother is not giving me keys of the 2 rooms which were under possession to me prior to 2007 and also were used by us when we visited jaipur frequently during 2007 to 2014,the intention of my brother is to grab the whole flat , what should I do now to take possession of half flat or atleast 2 rooms. The entrance in the flat is common through one gate, kindly reply me and if necessary ask me other details also

illegal transfer of property from joint holder to family nam

Greeting to experts forum...myself kamal mitra residence of vaishali sec7 ghaziabad. At present am staying in Abuja, Nigeria for 3-4 years. Am married in Nigeria and staying with family....
I have a case of illegal transfer of property which is jointly hold by me and with my brother. Now my sisters are saying that elder brother has changed the WILL and put his wife's name on it..he used my old power of attorney which he asked me for changing the bank loan details..it was 2-3 years back..I left India since 2010 and never came back india due to some reason or other. Now am fearing that he will sell the property without my knowledge the way he changed my name in the property after I refuse to sign the general power of attorney or the document he sent me few months ago. I still have the details. It will be really great full if anybody can guide me what to do and how to do!! If I recover my old copy of the power of attorney from the Indian embassy here and also make a new power of attorney to prove the difference between them...how can it help me and how fast...is their any way that I can register F. I. R from here through any NRI cell/ helpline..

Eviction of occupant

I have granted my brother - in - law ( X ) to use a portion of the ground floor of my old residential house as his office , free of any cost. He does not pay any rent or maintenance expenses . Now I want to sell the house . I have found a buyer and who wants peaceful possession of the house within two months ( strictly ). I am ready to shift to my new house . But my brother -in-law does not want to vacate within two months even after agreeing ( verbally ) to give him Rs.10 lacs as gift as demanded by him.
Questions :
( a ) What is legal position of X ?
( b ) Shall I write a gift certificate in his name stating that he must vacate the property within two months ?
( c ) What other steps can I take to evict him after paying him the gift ?

I have entered into a un registered sale agreement with a developer to buy two plots 30�40 each for 19.2L in january 2013 paying 10L.But till date the developer is not coming forward to register the property saying there is some case pending on the land with previous land owners for non payment.What shold be my couse of action?

How to get patta for my land

Dear Sir/Madam.

My father recently completed the sale deed on my name. I live in overseas . My question is how I can get a patta transfer from dad's name to my name and whether it is possible to get it done without traveling to india. Please suggest .

Circle rate of area.

My Grand father purchased and rented/leased out a plot of land of 400 kathaa in year 1934. Now in year 2015 we intend to sale the same plot to same tenant/leasee, but he is offering a price which is much below the circle rate, as because he is tenant since more than 80 years.

1) Can registrar reduce the stamp duty seeing that the property is fully letout since more than 80 years.The said plot of land is located in Howrah area of West Bengal.

2) If registrar can reduce the stamp duty, than up to what extent.

3) If I sale the plot below the circle rate what will be the consequences under Income Tax.

LAND RELATED QUERY


Dear Sir/Madam,

I have purchased a plot of land and constructed a
house on the plot.
The vendor and I both were using 8ft common
passage. Now the vendor
has sold his property to a promoter who
constructed multi storeyed
building (G+4). Does flat holder has right to use
that 8ft common
passage or not.

Booking cancellation

I had booked a flat in KUL Utsav kondhwa Pune (in Sep 2012) at that time residential NA was not issued. This property is being constructed on industrial land. All major bank had approved this project like HDFC and PNB bank.
Last year PMC has put the stay on construction and ask builder to submit the NA.
Till now I have payed 90% of agreement value since my building is 80% completed. My flat is not yet registered because I was out of town for 2 yeas and now there is stay from last 1 year.

Now I want to cancel My booking but builder is saying as per agreement they will deduct 5% of the amount and then they will open the flat for sell. Once flat is sold then only they will return my money. I sold my parental property to buy this flat and now having hard time. Please advice on above matter.
