Equitable mortgage

Will registered Equitable Mortgage of certified copy of title deed with the sub registrar's office in one bank have precedence over EM of original title deed of the same property created later with another bank?

Validity of notary registration and bond

Dear Sir / Madam,

X is a person who purchased the property of B two years ago.now till the date the actual trfer was not made by B.
But now B have a financial problem in such a situation C is ready to buy the same.

Therefore was type of precation are to be made by C while obtaining clear & legal matter.

Kindly Advice the same.

How to reach my land legally

Sir/Madam,
My home is in Raikwardih village in the state of Uttar Pradesh. My neighbours encroached in my land and made a wall. Thereafter, we reported to police and put the case in district court. Now, the problem is that my land is surrounded by neighbour's land. And if I want to take a tractor in my land I need permission of neighbour. Please help me what can be done in this situation.

Property documentation

Hi,
Request a legal opinion on below query.

1.Ms.A gave notarized GPA to Ms.B who are not relatives.This was in Year 1999.

2.Mr.C bought a property in the name of his minor son in 2003 where Mr.C is a guardian. Minor child was 15 yrs old in 2003.
This sale deed don't carry a signature of Ms.A but only signed by GPA holder ie Ms.B.

3.Child passed away in 2012, so the khata transferred in the name of Mr.C by Bruhat Bangalore Mahanagar Palike, as he was a guardian when property was purchased.

4.After Khata Transfer Mr.C did a Gift deed of this property to his younger brother Mr.D.

5.We bought this property from Mr.C & Mr.D as sellers & we also got a Consent witness from Wife of Mr.D & also from Ms.A (who gave notarized GPA to Ms.B).

Pls suggest if we have followed all the legal procedures correctly.

Pagdi system

Sir,
Kindly assist on the below query:
My father in law and mother in law had two rooms in a building which was on Pagdi system. They had three sons. After their death, the rooms were transferred to two sons. The elder son (black sheep) was away from family and is a NRI. Now both the sons whose names were transferred are dead leaving behind their wives and children. Last month the building was demolished and owner says that these two rooms belong to Father in law, mother in law and three sons and says the wives will not get the share. Actually the owner wants to find out loop holes to fund the property for him.
Kindly advise can the wives of the deceased get the property? And does the elder name have a say if the rooms were transferred to the two other younger brother?

Property bequeathed to minor

My friend bequeathed his single bedroom ground floor property at Hyderabad,Telangana to his 11 months old minor daughter and died. The property was duly registered in his daughters name while he was alive. Now the wife of the deceased person and mother of the girl who is the natural guardian of the girl wants to sell the property as she has no means of income to raise the girl. She has approached the court for permission to do so. Will the court grant her permission? Can the property bequeathed to a minor be transferred to the guardian or other third party for selling it off?

Property tax and noc payment by builder for gavthan flat


Respected Sir/Madame

I am a central govt employee and very new to this ascpects for sale of flat and related documentation and payments.

I have a flat in Nerul, Navi Mumbai. Its on the gaothan area and the builder was supposedly the owner of the plot also. It is a Gaothan Plot with Tri-party agreement + CC + OC + Stamp Duty Registration + Possession Letter from the builder.

Society is not registered and the builder has always been giving some or other reason for not getting it registered.


I want to sell this flat for which I would need the following:

1. NOC from the Builder as he is asking some money for it.
2. it has been told to me by my agent that Property Tax has to be paid as NMMC has issued (for entire building)and it has to be shared between the flat owners. in that also few have not yet paid the property tax yet.
I would like to have an expert advise here as how can I get the property tax documents on my name and I am not aware of the property tax.
who will transfer the property tax bill on my name?
are there any more documents that i should be in possession. Without registration of the society can i get the sale of flat deed completed.
Kindly advise me with the right steps

Registration of partnership property

Dear Sirs,

Myself and my brother are a partner in one partnership firm at Thane - Maharashtra and having one industrial shed at Thane in a registered society on a lease period of 999 years. Now I have decided to retire from the said partnership firm and my brother will continue the same firm by admitting his family member as a partner.

On retirement, I will get a 50% of of industrial shed. But society is asking for a registered document which should be duly stamped for the division of plot and to get my portion of shed to transfer in my individual name. I am ready to pay the stamp duty and also for the registration of document. But I don't know which document I have to prepare on which I can pay the stamp duty and get it registered. Is it only a retirement deed or something else?
