Letter of administration

my mother died 6yrs back(at the age of 65) who was living at mumbai since her marriage without writing any WILL.she has a proerty
in Tamilnadu.my father and my brothers all had given their consent to me and I have got 'The Letter of Admministration'from Mumbai High court in my name.But the Sub registrar in Tamilnadu is not accepting the LOA for transfering the property to my name saying that they want the Hairship certificate and Power from the heirs.Now what should I do as the Hairship certificate procedure is not in Mumbai

Private property encroachment

Respected Sirs,
I am Kumar residing in Madurai,
My father got 5acres of agri land in Kodaikanal in 1981, due to his health and family reasons he could not visit and maintain the land for several years but he routinely pays the property taxes and he has all the documents like sales deed, mother document, patta chitta, A register copy, FMB, Topo sketch, Adangal current, EC from 1981 to till date, up-to-date online chitta extract, surveyor's certificate etc.
Now he is in his seventies, when I went to see the land last week along with my father, the 2 nearby land holders not allowing us to enter our land. They said that my father's land is in their enjoyment now, they are asking for 50% of market value of land as compensation to vacate our land.

Somehow we managed and made them to agree for surveying our land first. After survey we came to know that our land is completely free from any encroachments. It is still completely tharisu (waste land) and not being done any agriculture activities, as we left it. But still they are asking for 50% of market value otherwise they threatened us that either they will not allow us to enter our land or not allow us to sell the land.
•They are not our relatives,
•We have not purchased the land from them,
•They are new to us and,
•We never left our land for lease to anyone,
•They don’t have any legal papers on our land (they don’t even know exactly how much land we own there),
•They are just nearby land holders doing all this in the intent to get money from my old age father.

Kindly help and suggest the proper way to deal with it.

We are hindu. Father died without will, my mom 4 sisters and including me one other brother. My brother having possession on our family home . We want to sale that and want our share but he is not agree with it. What should we do ?

Regarding car parking

Respected Sirs

Iam parking my car in front of my house i,e, on road side. The road always belongs to government. But iam not parking my car in front of others houses.
Others are parking car in front of my house and causing difficult to park my car. I do not have car parking facility inside my house.

Mc election and action by old committee for sgm

I bought flat in redeveloped building in 2013, which got OC, and i got possession in May 2014. building has conveyance. now in July 2016 builder is getting us added as member in the same old society and not forming new society.Old society as it is will continue and thier MC members.

MC term was expired in Jan 2016 and they applied with registrar for election as per new bylaws now on 18th July 2016. in the mean time they are planning to call for Special General Body meeting to conculde the resolution of new flat purchasers to be added as member and to structure the monthly mantenance charges, forming of society rules.

1. whether the above transaction is valid as the committee term was expired and new committee is yet to be formed?

2. can still the chairman call for SGM? current year AGM is still to happen and Financials also pending.

Kindly suggest.

Sale deed vs town survey records like plr or fmb

Hello Sir,

The property originally belongs to 1951 that time the extent was 9cents but after various sale with valid patta the extent of land increased. The town survey record like FMB or Permanent Land records shows the present extent of land and ownership. Now dispute arose on extent of land after 65 years through PIL as encroachment on road side. The court asked thasildar to verify the sale deed. But the same thasildar has given the patta for the present extent.

Which one is authenticated document sale deed or FMB/Town Survey record

Rent Receipt Name Change

Dear Sir
I am Prashant staying in tenanted one Room Kitchen at Grant Road.
"Our Room is still in the name of my Uncle". Uncle died in 1967 & his wife died in 1975 . Uncle is having two daughters .Both the daughters married in 1965 & went to their Husbands house.
My Father & Mother was staying with my Uncle since 1960 in the same Room. Uncle & my father are Brothers.
My father died in 1998 .
In 1998 , I had gone to landlord & request him to transfer the Rent Receipt in my mother's name but he refused.
1) Can I file a case against landlord ,for the transfer of Rent Receipt to my mother's name ?.
2) Now after 50 years two daughters of the uncle are saying that this is our room.
3) Can I completely Wash off (Remove) the Rights of my Uncle's Daughters ? , Since both of them are not staying here from last 50 Years.
Please Guide me.

Procedure

I have got contested divorce from my husband 2014 and legal custody of the child (Son) is with me.
My grand father-in-laws purchased a lease-hold property (House) in 1960’s at New Delhi. Since my grand father in law died in 1980’s without leaving any will. Therefore, in 1997 My father-in- law & his brother applied for free hold and & got that property registered in their joint names. Later on in the year 2000 they divided the property equally and executed partition deed which was also registered.

Query:- Now. I have come to know that my father in law has sold that property to one of his son.( i.e. my brother in –law ).
2. Can I file any legal suit to claim for myself and for minor son’s rights on said property.

Sanitary system

Sir,
1. Any law is existing and constituted regarding Sanitary system should be commissioned before issuing Completion/ possession certificate for Flat/Independent house at Urban area Layout by concern urban authority in Karnataka under Swatch bharat mission.
2.After expiry date of Sale deed, in spite of reminder letters for registration of flat, whether buyer can file the case at courts of law without serving any legal notice to vendor.

Cancellation of Sale Deed

I have recently purchased property (clear title and self acquired); now his son filled case in civil court for cancellation of sale deed. My advocate is defending case well. My question is - When a person can file suit for cancellation of sale deed? And Who can file suit for cancellation of sale deed? Becz i heard that suit can be filed only by a person who executed document and who perceives. Is it correct?
