property belonged to deceased mother;

Deletion of name of one of the owner's in residential prop

Dear Sir,

We have a house in a coop Hsg Soc in Kandivalai (w), Mumbai. This is in the name of my son (as the first owner ) and my wife (second owner) purchsed in Nov 2007.

We would like to delete our son's name and make the house only in my wife's name.

How to do this ? What is the modality ? What are the implications? In nutshell what are the formalities to be completed?

I will appreciate a reply to do this query.

Flat Deal Cancel

Hi,
I had flat deal after paying downment i had it registered and applied for loan. But, due to Society registration and CIDCO transfer not happening i am unable to get loan from any bank.
Is there any rule, which says,
On cancellation is the seller subjected to return all the money back to me that i have paid him?
Please Help.

What's defintion of the word "immediate" in section14D/DRC ?

What is the definition of the word "immediate" in section 14D of Delhi Rent control Act?
I am pasting here this particular section of this act----

"Right to recover immediate possession of premises to accrue to a widow. - (1) Where the landlord is a widow and the premises let out by her, or by her husband, are required by her for her own residence, she may apply to the Controller for recovering the immediate possession of such premises.

(2) Where the landlord referred to in sub-section (1) has let out more than one premises, it shall be open to her to make an application under that sub-section in respect of any one of the premises chosen by her."


In day to day life by "immediate" we mean " accomplishing a job/work without loss or interval of time."But this simple definition is not perhaps accepted by Indian judiciary--by immediate they perhaps mean 6 months or 8 months.Can you tell me whether I am right?If yes,how they decided this time frame as "immediate"?
Or If I am wrong ,do they deliver justice in the trials under this section immediately,I mean within days?
Can we ask this question to Indian Govt. through Right to information act--RTI,if yes,how?

deed of surrender of leave & license agreement

Dear Sir,

A leave & license was entered in to at Mumbai for a property at Mumbai. The said agreement was registered with sub registrar as per Maharashtra Rent Control Act.

Now,as mutually agreed the said agreement is terminated and a deed of surrender has been signed by paying stamp duty of Rs 300/-
Rental value was Rs 2.50 lakhs per month and deposit Rs 9.00 lakhs
Querries:
1)Whether it is required as per law to register the said deed of surrender?
2) What are the consequences if the deed of surrender is not registered?
3) What is the stamp duty payable on the deed of surrender?

Recovery Proceedings as recovery of land revenue

Consumer court passed order in complainant's favor but the respondent didn't comply with the order. In execution proceedings, the court issued recovery certificate in my favor and it is sent to DC's office for recovery of amount as that of land revenue. Along with this a memo of properties of the respondent was also sent which I filed in the court. The DC sent it to the Tahsildar's office and the proceedings are pending. The respondent is strong builder and not getting the recovery proceedings to went through.

What is the option with me to get the recovery done? How can I expediate the recovery proceedings? Pls let me know.

Housing Society not issuing Share Certificate and transfer

Dear Sir, i have bought a resale flat in sanpada, registration and Sale dead happened on 16th sep,09 and 20th Nov,09 respectively, i have taken possession and i had submitted all the required document to transfer and issue the share certificate on 26th jan,2010, but inspite of writing many letters to the secretory but they are not responding,and the maintenance which are coming that too on old owner's name only, even ignoring my letters which i drop in drop box along with the mantinance cheque,please suggest what do i do? attached the letters which i sent to secretory.
