Parental Property Issue

Hi All,

I need help related to my parental property issue. my father died in 2007 and had one plot and a rented shop when he died. we are three brothers and before father death he wrote a letter in which he divided the property among three of us but that is not registed will. Father devided the plot in two parts one for me and second for my younger brother. and i was always sit with my father at the shop which is rented. so that shop is for me. and for elder brother my father wrote he gave him lots of money to start his bussiness so there is no property for him.
After father death my elder brother wants his land on the plot. some for relatives involed in this issue and tried to convience my elder brother to sign on that aggrement that yes that plot is for my rest of two brothers. Now i want to sell that propety and i am afraid that he will create problem in selling the property. so right now i what i am i do for to avoid such condition. what are the legal steps to sell that property.

Sir

I've taken a house property in the SARFAESI ACT public auction conducted by a bank. Now i want to register the property directly into my nominee name due to insufficient of funds. He is ready to pay the total sum and ready to register.

Is there any possibility to do like this and if so, kindly let me know the SARFAESI ACT section details.

marital dispute property law

my husband bought commercial property which he has paid off except of the existing bank loan which is being paid through bank loan from his salary account .only a small part has been paid by my father.now that there is a dispute between us i would like to know my share in the above property , as i trusted my husband implicitly , i never checked the details of above , my name does occur as co applicant and have signed for consent on the bank loan forms also.

Execution of will


I regret to state that I have lost my father on 24 Mar 2011 at the age of about 80 and my age is 55 years.He has made a will for the only house he owned at Bhilai / Durg ( Chattisgarh state) ( with his life time efforts) and as per his will he has nominated as beneficiery of the house.The spirit behind the will is that I dont own a house while other two have. All moveable assets have individual nomination. Other wise I have younger brother and sister. The will has been prepared by an Advocate and it is registered also.Secondly as per writen intructions on envelopewe my brother and self have jointly opened the envelope. we have Also I am a retired defence officer. I had approched the same adovocate for necessary support. He sent me a draft filing a case to Tahsildar but against my brother and sister. We have excellent relations and I dont want any hitch arising out of this.So I am in fix and not able to take decision.

Now please advice me :
What is exact procedure for enacting the will? does advocate who prepared the will have some responsibility?

Do I have to file a case in court against my brother and sister or better alternative is available

Iwhat will be the expenses for execution of will

I am working at Ludhiana and hence would not be able to frequently visit Bhilai. Can the case be filed here localy or any other option

Further for registration what will be the expenses, stamp papers etc. i am a retired defence officer does that give me any benefit

Would appreciate your advice to extend possible. Can concuurence obtained by me from my brother and sister will help?

lease deed

Sir,
I have to get registered lease deed for nine years at cheenai. what is stamp duty and registration charges. as how somewhere i came to knew that it is on average annual rent plus security @ 1% as stamp duty and 1% as registration charges. please let me know.

Plz solve my problem related to industrial land... plot no 15,16 and 17 are allotted to a Pvt ltd by Industry departmnt on lease to pvt company since 20 year...there are single combine original excuted lease deed of plot no 15,16 n 17... now company want to transfer all three plot to Mr X,Y and Z separatly. for FINANCE bANK ALWAYS mortgage ORIGINAL LEASE DEED... Now my query is that how is possible to divide original combine single lease deed of plot 15,16 and 17 between their Three new Owner.

Issue of Parking space between two societies

Two societies are located in the same complex (VASAI E) and are currently sharing common entrance and parking space.

Society "A" which is a 7 storey tower was built first. Subsequently the promoter had built Society "B" in the space meant for Garden of Society "A".
Society "B" is also a registered society for the last 5 yrs.
Now society "A" has issued a notice to society "B" stating that "B" is built on land meant for garden of "A", hence they are entitled for parking within the compound and also "B" must have there separate gate from the back lane of the building.

Property Share

Dear Experts,
My father have some aggricultural land. My family is three sister and one son including my mother, in 2004 my father give the all property for me by registration,and in year 2006 my father is passed away, but in this registration deed we are not mentioning any thing for daughter, Then in 2005 as a son i am sell some of the property to third party, now the problem is one of the my second sister file the suit for her partition in 2005.The case title is My sister is plaintiff, and My father, my self, First daughter, third daughter, my mother, and purchaser are the diffendents.My father is passed away after commence the case.Then My self and my father,mother& third sister are the Exparty's in this case,
one more thing is property are not a self aquaired property for my father.
My question is:
1) I got registration deed in 2004 this will help me or not?
2)My fathre passed away in 2006 this will help for me or my sister?
3)I have already sell some of the property for third party, this can problem for me or purchaser?
4)Case is filing only one of my sister, how this possible?
5)any possibality to she will win the case?
6)If she will win the case how much share she will get?
7)Another two sisters have share or not?
8)My sister is asking 1/3 share in the entire property, how it is possible?
9) I only win this case, please let me know way how to win?

Please calrity my doughts and tell me next better step.

Reparing of the Terrace is whose reponsiable

We are the owner of the Flat whose celing becomes the terrace of the Society. The terrace is leaking form last 4 years but the Society committee members are only passing resolution and not doing any thing. We are give letters to the society but no action is taken till yet. At present the Registrar has dissolved the committee and appointed two people, they are not ready to take any action as they say they dont know any thing and they even reject to accept the letters given by me
Plese help wht to do now
