Hi!
The 'C' company have acquired an Indian company through purchase of shares (99%) in 2011. By virtue it becomes a 100% subsidiary. Now this subsidiary was acquired from 'A' in 2005 by 'B'. In between the period 2000 -2005, the name of Indian company changed many times. The land documents i.e. registry is still in the name of 'A'. No one changed it since its inception in the year 2000.
Now 'C' needs to prove the clear title for company land ownership. C have all previous land documents, Scheme of arrangement issued by state court, property tax payment receipts everything.
1- Will this be enough to prove clear title?
2- I understand that clear title means that property can be mortgaged. Am I correct? If banks accept these document & ready to mortgage the property then we can say it proves clear title?
3- Any other options you can advice me, please. It is urgent.

n my village,We have my grandfather's property registered in 1984 on behalf of his 3 sons.But till now they did not do any registration of their own in their name.But one of his son made registration of his partition on his wife's name.I am eldest son's only daughter who wants to register her father's partition on her name.All of a sudden my dad's younger brother's son(whose father expired in 2002) occupied one of my dad's partition property by locking the house.Recently I myself,My dad has made a "veelunama(telugu)" / Legal hire for dad's prorpety after his death to me.At the same time due these non-sense, as I am a lady do not want to get into trouble,planning to register my dad's property in my name as a gift given my dad.But my dad is not able to do this,since he is scared of my dad's younger brother's son(who has support from the local panchayat lead). In such case, how can I proceed to register my dad's property without any issue?. Is that 1984 WILL , Latest Legal Hire are enough for me to support? . If not how could I proceed further to complete the registration?. How could I approach?. Can I lodge a complaint on him for locking my property?.If so, can I avoid that local leading political person by using any LAW?.please let me know.

The flat i live in was owned by my mother who died in 1982 , my father was nominee but he too died in 1986. My elder sister married in 1994 and i have been living and maintaining the said flat all these years.The flat still stands in my mother's name and now society is going for redevelopment. My sister and i are not in good terms and the society wants us to resolve the transfer asap.
I have made a application to mainatin status quo ..but they say they need to make agreement with builder and need a name. My sister who has been married and away all these years is now making demands knowing her importance. I need to time to do the settlement with her .
1. Can the society force me (legal hier) into something i'm not interested in?
2. What happens if i don't sign the agreement with builder ?
3. Since i'm in possesion of the flat since all these years and mainating it ,can the staus quo be maintained even after the new busiding is ready ?
4. What do i need to do to safeguard my position?
Please Advice .

sir, I am the owner of a land piece of 1 bigha which was financed by my father in the year of 2000. now my father made a house there in 2006. my parents have no problem but my brother have some problem in this regard.
so now i want to give this ownership to my mother.
please give me the best advice that can be in terms of minimum cost.

A property consisting of 2 equal wings say 1 & 2 (HAVING SEPERATE ENTRANCES) stands in the name of A B (BOTH BROTHERS) C (FIRST COUSIN OF A B ) AND D (UNCLE OF A B & C). ON EXPIRY OF D HIS WIFE BECAME OWNER OF D'S SHARE. HOWEVER SHE ALSO HAS EXPIRED. D & HIS WIFE WERE ISSUE LESS AND USED TO RESIDE WITH A AND B. C WHO USED TO STAY AT SOME OTHER PLACE ALSO HAS EXPIRED. NOW A & B IN NEED OF MONEY WANTS TO SELL ONE OF THE WINGS SAY WING NO.2 (HALF PROPERTY)
CAN THEY DO THAT WITHOUT CONSENT FROM SUCSSESOR OF C (D BEING ISSUELESS)

Hi, I have a question regarding flats in cooperative society situated on a plot which is leasehold…
I am looking to buy a flat for myself & have seen flat in old building in mumbai. The society is registered housing society. However, the plot is not owned by the society but is given on lease by an individual. Lease period is 99 years – balance lease period is less than 50 yrs…(One may think this is long enough but considering the HUGE property prices in Mumbai this appears a limited period)
I will like to know – What happens when the lease period gets over? Are the owners required to vacate the flat?? What kind of payment is required if the lease is to be renewed?? Can the lessor ask for termination of the lease even before the lease period is over?
Does the law anyway protect the flat owners in such case when the landlord does not want to renew the lease??
Request you to kindly reply urgently.

We r two brother i am working in indian army and my youngest brother has jobless actually he doesn't want to work he is very lazy type, we both r married i am in my duty station since 18 years with my wife and two kids they dont want see me they always treat me as a step child even they dosent love me my brother r very clever he cofess my father and mother and they loves him very much and planning to give all my fathers property to him , is there any rule that i can get something ? plz help me out
Brokerage payable if property deal didn't go through
Hi Experts,
I am currently in litigation with a prospective buyer of my property. I wanted to back out of the agreement due to personal reasons. The plain paper agreement on broker's letterhead did not mention any brokerage rate or that the brokerage is payable. Now the broker is threatening me with a legal notice, saying that I need to pay him the brokerage- that too, not only my share, but the share of the other party too since I backed out. Is brokerage payable if the deal ultimately did not materialize? Is there any law which governs the brokerage rates?
