Son's Right over ancestral property

Hi,my father runs an ancestral petrol pump which he got from my grandfather. The land on which the petrol pump is there was bought by my grandfather from somebody.

After death of my grand father the land is now on my uncle's name but the petrol pump is run by my father.

My father left my mother and children(myself and my sister) 7 years back and has married another woman without taking divorce from my mother, also we were thrown out of the house and has no financial support from him.

What rights do I have over the petrol pump and the land as it is an ancestral property ans is not acquired by my father

Cancellation of land aquisition in GNOIDA

Sir,
I have booked a flat in Noida Extension. Now, I am fearing that whether i will be able to get my flat after cancellation of land aquisition by SC. My builder says there is no issue with their project as the farmers have already accepted the full & final compensation & in such case courts can not cancel the land aquisition. Is it true.

Thanks in advance.

To get back my sold property

Hi Experts,

Iam looking for a proper solution, which make my mind restless.

We have a grand parents property within chennai limit, we have full right of what ever we want to do, me and my brother alone have the rights on the property and we sold half portion of property say 80 cent at a period of 2005 at a cost of less than 50 lakhs and more over we both have no idea of economic booming on the real estate side. Now the property value has gone high at a cost of say 4 crores.

This make more stress to me and my brother body and soul.

Now i need a good knowledge from an expert that any way to get back my solded property or get additional cost on the land which we sold a cheaper cost.

Looking for positive feedback .

Thanks,
Babu

Thanks all for your reply,

The said property was belong to my grand mother( ie., father's mother) who created a will and got decree by highcout chennai during 1970 clearly stating all the property belong to their grand son's. So as per will me and brother alone have the right.

Now my question is :

My one and only elder sister if she applied against the will in the court which was created in 1970 and decree passed by chennai highcourt by using current law stating equal right on property for women, whether she can get break that will as well as the decree passed, if so in that case, she may got a right to put a suit against my sold property right.

Please through a light on this.

REGISTRATION OF SPECIAL POWER OF ATTORNEY

I have seen a query anwered by experts which states that special power of attorney for sale of immovable property is compulsorily required to be registered.

Can the experts anwer with reference to the section of the registration act?

According to me if the executor of a document gives power of attorney for presentation of the said document for registration then that power of attorney is required to be authenticated.

But if the document itself is executed by a power of attorney who himself presents it for registration the said power of attorney is not required to be authenticated.

Kindly enlighten with the provision of registration act.

Gift deed of a vacant site

I purchased a site at bangalore in 1996 from X through registered sale deed. X got the ownership from registered gift deed from Y in 1980. Y was the registered GPA holder from the landlord in 1980 (1.5 months before the subsequent gift deed).
The original GPA states that GPA holder can sell the property and file affidavits. It does not state that gift deed can be executed or any other clause which mentions that handover be done in any other means as desired.
GPA was signed by landlord and his son (both expired few years after gift deed).

Can the grandson of the landlord file a litigation against us? If he does so, is it easy for him to claim the ownership of the site legally? (The property is in our possesion since 1996 and obtained Khata and paid all taxes)
If I proceed to construct a house, can Grandson of the landlord file a suit and stop the construction?
Is it suggested to sell the land?

Court auction

Hi,
Court auctioned a property of the accused in a recovery suit and a party won the bidding and paid the amount to the court, way back in 1960s. Court passed all the rights to the Party that won the bidding and asked to have the mutation done with the revenue department to get the perfect title. The party approached the government for mutation. Meanwhile there were several cases in both lower and high court contesting the legality of the acution. But all the courts upheld the auction.

Still the mutation is pending. We have the following questions.
1) Is there any time bar on the mutation?
2) Is there any time bar in approching the court on its earlier order?
3) Is there any time bar in asking the court to implement its earlier order and handover the property or equivalent property or any other compensation?
4) If cash compensation is asked , what would be the interest rate and how would be the opportunity cost calculated?
5)Which is the best option, either going to the government and pursue the mutation or going to the court asking to implement its earlier order?

Thanks
