Dear Expert Sir
We r living in flats under kolkata municipal corporation KMC since 2006.Total 24 flats all have been registered in 2006 and handed over by builder.Builder is having rights of roof under initial agreement. Now 22 flat owners had applied for mutation in Kolkata Municipal Corporation.02 flat Owner did not applied. Builder did not make any arrangment for forming resgistered socity.Builder is not even responding and giving reply to the registered written request. Maintenance of flats is being arranged by flat owners without forming any socity.Even few flat owners are not giving monthely Mainteance Cost.
Now our questions are 1. can KMC issue mutation certificate to flat owners even if 02 flats owners of same plot not apply for mutation.
2. Can we form a register houseing socity without permission and without including Builder as a member.
3. How we can ensure that all members pay mainteance cost.
4. If any member refused to pay mainteance cost what course of action can be taken aganist him and under what law.
With Thanks
V Sushil Kumar

Hello:
I have recently purchased a flat and the flat number alloted by my promoter was no. 8. The Deed of Conveyance mentions the flat no. along with all other details like sq. ft. area, south-west facing, etc.. and the only thing wrong is the flat no. Another person in the same building also has the same flat no. though the rest of his parameters are all different. I spoke to the promoter and he says that this is a trivial change and he can get the original deed modified for this as its just a typo. Is it such a simple process or is there something more to it? Do I have to get a rectification deed done? If so, will I have to bear the entire stamp duty once more?

Is adopted son eligible for a share in the inherited property of his biological family. I ask this, as at the time of adoption, the person adopted is a child and hence not in a position to decide

Dear ALL,
We are residents of Jharkhand.
My mother owned a plot in PUNE, Maharashtra, bought in 2006. She unfortunatly expired in April,2007 leaving behind father and we, five brothers. There are some other properties in Jharkhand in my mother's name.
Recently, in June 2011, we, all legal heirs reached an oral undetstanding that the property in pune is mine(i.e. my Share) and rest of the partion will be done later on suitably adjusting my share in the remaining properties later on.
Thereafter, this oral understanding was reduced in writing as memorandum of partion deed, on a Rs 50 Stamp Paper and all the legal heirs signed the same.
However, the same was not registered.
Now , I am planning to sell the property situated in pune. But the buyer is saying that the Memorandum of Partition deed is not valid as the same is not registerd. My advocate in Ranchi clearly says that the deed, in the circumstances mentioned is not required to be registered and is valid as held by various courts.
As per registration Act, as I understand , this is not a document which is compulsorily registrable.
May pl advise if I can sell the plot as owner of the same as per the memorandum of Partition deed( which reduced the oral understanding in writing) which is NOT Registered.

Though you have been answering all querries, I am surprised that I did not get a single advise on my request. Have I done something wrong or I have asked for too much I could not understand. May be to explain in detail, I made the query little long. With regards.

We are constructing a hospital after getting proper approval from the local authorities.
Our construction plan is slightly deviated from the approved plan. What should we do to get the new plan approved? Can our neighbor approach a court to stop our construction stating that our plan is deviating from the approved one and he doesn't like a hospital in his adjacent plot.
