Dear Sir,
Is it possible that my granfather can transfer all properties(ancesstral) directly to me and my brothers. As my father is living separately and sharing no family responsibilities. What is the procedure? Is it possible through registered will by my grandfather forefeiting my fathers right in properties? Or there is any other solution by which all property gets transferred to my brothers and mothers name and father does not gets any share after my grandfather's death.
Thanks in advance,
BPM

I am currently in the process on buying a property in Chennai from a real estate person (MR-X) who has power of attorney on the land and converted the area into layouts.
As per the registered documents available ( EC has been done ) and i have all documents as per EC records.
The property was bought by MR Raman in 1961 ( This is the mother document, I have a copy). He has 6 children ( 4 male / 2 female) all married and alive till now.
Son1 - 54 yrs old now
Son2 - 49 yrs now
Daughter - 47 yrs now
son4 - 44 yrs now
son5 - 42 yrs now
Daughter6 - 42 yrs now
( note the above people have more than 1 son/daughters who are major now)
1) Mr Raman died in 1997
2) His wife died in 1998
3) no will or any deeds were written by Mr Raman on this property
4) the death certificate / legal hireship certificate issues in 2007 states above 6 are the hires.
5) in Jun-2011 5 brothers and sisters have written a release deed to "son2" stating that they have taken 10lk and giving this release deed ( which is registered)- note- only the 5 siblings have signed the release Deed to SON2 ( the grand children have not signed the deed)
6) In Aug-2011 MR-X ( real estate person) takes power of attorney from SON-2 ( which is also registered) and developing a layout on the land and selling it.
Can I buy this property from MR-X. My only question is "Is the release deed given by 5 Siblings to SON2 valid without the grand children's signature)
Thanks in advance for your responds.

If the Partition Suit filed by daughter by her mother as a care taker, can demand 50% from me..?
It seems there is no merits of Arguments, Can I challenge for dismissing the partition suit.? & Demand for the Damages made..?, They advertise the local news papers saying that Properties Not to be BUY / SALE.
Investor has signed MOU with Developer on july 2010 on 100 Rs stamp paper. The MOU is not registered.
The MOU is to give advance for Construction of Building as per progress & to hand over entire building by developer to Investor.
Since the Progress is delay & now the investor is becoming partner in place of retiering partner of developer firm.
What are the steps to be taken before becoming partner? wether registration of MOU is required?
After becoming partner he him self will bound his partnership firm where his profit share is 25%.

Dear Sir/Madam,
Myself and my friend jointly bought 0.22acres(10000 sqft)of dry Agricultural land in the year 2004 at Kalapatti, Coimbatore. The property was registered as agricultural land in the sale deed. Now we want to make a partition deed and register it.
1). After partition, each one's share will come 0.11 acre(5000 sqft). Is there any minimum area limit to specify a land as Agricultural land? (This doubt arised to us because, our each shared area is only 0.11acre or 5000 sqft)
2). In the partition deed, can we indicate our individual shares as agricultural land?
If not, how it shall be mentioned?
Thank You!

Hi Experts,
I entered into an agreement in Jan 2009 to purchase a property & in furtherance cleared bank loan on the same as requested by Seller.I am in possession of all orginal documents of property.
Subsequently on many occasions the seller kept dodging the execution on sale deed even though i have paid 80% on the considerations in Jan 2009(Citing reasons market value has increased).
He tried to sell the property to 3rd party & I moved court vide specific performance suit, was granted injunction against the Seller.
The seller reqeuested for mediation & during the proceedings in threatening to file atrocities case & other false cases if i do not withdraw the case & take back my Advance amount.
Pls advise on what should be my guard & defense against such false cases.

Hi Experts,
My relatives purchased a site in 1983 vide a registered sale agreement & an notarised affidavit by the sellers confirmed complete receipt of considerations & put them in possession of site.
The seller once again sold the same site in 2004 & that person moved court for declaration & possession.
The court did not consider Sec 53-A (T.P Act) & passed judgement against my relatives to deliver vacant possession despite being in possession since 1983.
We have moved high court which was pleased to grant stay over the lower court order.
Request experts to guide on:
1) Whether we have a good case to take forward?
2) Should we file any other case to defend our rights on property?
3) Is it advisable to go in for out of court settlement?
Owner irritate us.
