Please guide me to Understand the Rights and Status of Agri - Land & Properties from Tamil Nadu:
Hindu Father Died died intestate ( year 1971 ) : without WILL ., On Succession All the Property Transferred to Widow wife's Name in year of 1972,
Current status : The Propreties considered all as Personal Properties or it is Considered Ancestral ? ( Properties not brought by father : transferred from Grand father )
As per HSA states that : 14. Property of a female Hindu to be her absolute property
(1) Any property possessed by a Female Hindu, whether acquired before or after the commencement of this Act, shall be held by her as full owner thereof and not as a limited owner.,
This mean's the Law give's full rights to consider as Personal Properties,
So in this case the Widow currently live ( Mother of 3 daughter's and one sone ) can gift this properies any one of the family members ?,
or : Son & Daughter's get equal share from the above properies ? , Can the daughter's file any partition suit..?, all daughter's get married before 1982, Please guide me.. thanks,

Hello,
i have purchased a property from the person who was alloted this property under Mhada. He made a power of attorney and a sale deed in my favour on Rs. 100 stamp paper in the year 2007, however the same is not been registered.
i understand from the rules of Mhada that the beneficiary can not transfer the property till 5 years from the date of possession.in this case i would like to know my legal standing in the property. i have also been given the possession of the property, can the Mhada or the beneficiary claim any rights on the property ? do i need any more documentation to safeguard myself ?

Sir, I had entered into a registered agreement with a buyer for my small property and the due date was june 10, 2011. I have taken a token advance for the same. But unfortunately, the buyer has not come back and whenever I call, his family members keep giving me some excuse or other about his ill health, he being out of station, etc. I would like to know:
1. What is the next procedure for me to do?
2. Within what period of time will I have to send him a notice for not carrying out the deal?
3. If I fail to send the notice within the stipulated time, what are the repercussions due to failure in issuing the notice?
Thank you Sir for your advice in advance.

Registration of agreement of transfer/sell
Is it mandatory to Register the Agreement Of Transfer or Sell of Residence property of a Registered Cooperative Housing Society as I understand that Section 41 of the Maharashtra Co-op. Societies Act Specifically provides for exemption from compulsory registration of an Instrument relating to shares and debentures of the Society. Nothing in clause (b) and (c) of sub – section (1), of section 17 of the Indian Registration Act, 1908, shall apply to any instrument relating to shares in a society, notwithstanding that the assets of the society consist in whole or in part of immovable property. Therefore, under the said Section it is specifically mentioned that such an Agreement does not require registration. In fact it has been held by Bombay high Court in its Judgement in USHA DONGRE VS. SURESH KOTWAL reported in 1990 Maharashtra Law Journal 306 that such an Agreement does not require Registration . Therefore, such an Agreement is not required registration with the Sub-Registrar of Assurances.
