As per Section 60(c) of Transfer of Property Act, 1882 at the cost of the mortgagor either to re-transfer the mortgaged property to him or to such third person as he may direct, or to execute and (where the mortgage has been effected by a registered instrument) to have registered an acknowledgement in writing that any right in derogation of his interest transferred to the mortgagee has been extinguished: According to this provision registration is compulsory.
However, as per 17(2)(xi)of Registration Act, Registration of redemption is not compulsory,
The section provides as follows
any endorsement on a mortgage-deed acknowledging the payment of the whole or any part of the mortgage-money, and any other receipt for payment of money due under a mortgage when the receipt does not purport to extinguish the mortgage
which provision overrides? is it compulory to register the redemtption of mortgage?

fact: 1)there is a agreement to sale between two independent persons,
2) agreement to sale is for a flat which is to be constructed by trasferor through the money given by the transferee, which will be situated at the 4th floor,
3) agreement to sale is not registered,
4) on the basis of this agreement to sale, loan is given by the board of the co-operative bank to the transferee, ignoring the fact that it is not registered,
5) loan is taken by the transferee to give it to the transeror, so that, he can construct the 4th flat and make registry of the flat afterwards and give the possession,
6) loan is wholly given on the security of unregistered agreement to sale,
7) the flat is still in the name of the transferor.
question: 1) whether agreement to sale of immovable property is necessary?
2) whether loan given by the bank is wrong as security is the flat which is not yet in the name of transfree?
please help.

Our society building was constructed in 1990 and its plan was approved in 1988.Our society was registered in 1992 and received occupation certificate in 1993. Till now the society has not receiced conveyance in its favour. During 2007-08 an application was by made by builder to amend the plan with some addition of area of ground floor office. The same has been approved by the authority. A new occupation certification was given in 2008. What is the procedure to be follow for this amendment of plan once the society is registered? Does the approval of the General Body of the society required for any such amemdment? what is the remedy if any such approval of the Geberal Body is not taken?
Members of the society came to know about this amendment recently. Only secretary was aware of it. The suspicious role of secretary in this process can not ruled out.
Please Reply.
Thanks.

I booked, about 3-4 years ago, a commercial shop in a mall being built by one of the top builders in UP. The mall is now complete and the shop is ready for possession. I have paid 100% of the cost of the shop. But suddenly a dispute has come up between the builder and the land owner. Land is owned by a private person and does not belong to the builder. There is some sort of payment dispute between them though have no idea on the exact issue.
I would like to know if its better for me to get the shop registered ASAP or wait till the dispute is over. I have paid 100% for the shop (in installments).
So the question is, am I safer by registering the shop in my name or wait or its possible that the registration may become invalid or can't be done at all. Is it possible that the registration can be cancelled later on by builder / land owner / registrar / ...?
Thanks.

I want to sell a land which I have acquired as a survivor of my deceased father. After the mutual partition,I have got the deed for the same but I haven't got the khatian(record of rights) yet.I have applied for the khatian and have the application receipt. On 23/10/11,there was a news in the local daily 'Dainik Sambad' that now a sale deed can be registered with the application receipt for khatian if the khatian is not received yet.I want a confirmation from experts regarding the same so that I can proceed with the selling.

I am planning to buy a property in Kerala. On scrutanising the documents I found that the present owner purchased the property in 1999 from a Muslim family of five members of whom one of them was a minor son of 14 years old. The father of the minor signed the document in 1999 on the strength of a POA he had from his minor son.
Is there any problem in buying this property?
According to the muslim law/ Or the minor rules. does the minor child at that point of time who became a major today has to be a party to this document ?. james

Sir,
I have purchased a flat in 2010 from a builder, and flat is registered on my name, khata is transferred to my name and I have paid property tax since 2010.
recently I got a notice from one bank, stating that two people have taken loan by showing my property details.
When I enquired with the register office, there is no record of those people and EC clearly shows from builder to my name.
This has been done to 10 flats in my apartment.
Some body created fake documents of our property and took loan from the bank and then defaulted.
Loan was taken in 2009 that is before I bought the flat from builder.
Bank which has given fake loan is a public sector bank and they have pasted notices on the flats under securities act.
I need legal opinion in this regard. What is the procedure reply to bank notice and whom should be made accoutable for this fraud.
We have approached police and gave compliant against bank.
Your guidance is really helpful.

Respected Experts,
A woman executed a registered settlement deed in favour of her fostered and unmarried son enabling him to enjoy a house for his life time and after his life time, his wife(to be married)till her lifetime. Thereafter their children, if any for their life time and their children so on. If they could not begot children, property should go to the heirs of his wife after her lifetime.
With these recitals a settlement deed was executed.
My questions are :-
1. whether such a settlement is valid or void. If so, under which provision of law?
2. If it is valid, who will get absolute rights, though document is silent about it?
pls advise me.
