My grandfather has bought a property in my gandmother name. Including my father they are 3 sons and 2 daughters.

I have got 2 brothers and im the only daughter. I'm married.

Now, my father and other siblings have sold the property and shared among 5 of them.

Question:

2. If yes and If i dont want to take it at the moment, Does my husband have rights to claim for the share if my father does not pay it to me?

Separation of immovable properties

Sir,

we have two ownership flats in a suburb of Mumbai. Both flates are of same price and having same area. there are we two married brothers, my parents and one elder sister (married) in my family.

in two flats, one flat purchased in the name of my Mother and we two brothers are nominees in the said flat. the second flat is purchased in the joint name of my brother and myself and our wives are nominees in the said second flat.

now my mother is expired, and we two brothers wanted separation of two flats. My brother wants the flat, which is in the name of my mother. where he is residing presently and i will take the other flat wherein i am residing.

our elder sister is well settled and she do not want any share from any of the property of my mother.

i want to know that what procedure should we need to follow to separate the ownership of flat in the name of our each one.

Loss of notarised power of attorney

Sir,
Last year I purchased a property which waS registered on jun 2010.
When I applied for a Housing loan on that property Bank legal advisor asked me to produce a Power of attorney - a NOTORISED one in 1996 sep- which was used in a title share transfer within the family.
I contacted the THEN TITLE HOLDERS OF THE PROPERTY and found that the person issued the Power of attorney is NOT ALIVE and the copy of the document(P O A) not with them.
Since it has been a notarised one No other copy from anywhere is available ,. Only thing I could manage to get was a confirmation from the NOTARY PUBLIC about the issue of it on 19 sep 1996
KINDLY GUIDE ME WHAT OTHER ALTERNATIVE I AM LEFT WITH TO RECTIFY THIS

G.p.a.

Is a GPA valid if only registered ?
There is a property dispute going on in the family. We are six children and out of which our father made two of them as nominees for a plot in a co-op. society. From among the non-nominees one son happens to be the witness in the nomination document, as such he ceases to be a beneficiary. Now the non-nominees have filed a GPA in a court making one of the sisters to represent them, including the son who is a witness for nomination, who has no claim in the property. Please let me know if the GPA can represent a non-claimant & if the GPA is valid.

Gift deed or sale deed

First of all thank you very much to guide me with respect to previous queries.

In family settlement i have to settle one flat with my brother.
we mutually understood that brother will pay me 13000Rs per month for next 7 years.
shall i add payment condition in gift deed?
we planned to file gift deed in order to reduce stamp duty.
shall we go for gift deed or sale deed?
please advice.
