Is a GPA valid if only registered ? There is a property dispute going on in the family. We are six children and out of which our father made two of them as nominees for a plot in a co-op. society.From among the non-nominees one son happens to be the witness in the nomination document, as such he ceases to be a beneficiary. Now the non-nominees have filed a GPA in a court making one of the sisters to represent them, including the son who is a witness for nomination, who has no claim in the property. Please let me know if the GPA can represent a non-claimant & if the GPA is valid.

GPA can represent for every person who has given power in his favour whether he is a claimant or not and such GPA is valid.

In transfer of immovable property, there is requirement of GPA that it must be registered for pass on title.
in other case, no such requirement.

yes!The requirement of a registered GPA arises only when an agency to sale immovable property is created by it;in all other cases not even any notarization is required.
