Sir,
Last year I purchased a property which waS registered on jun 2010.
When I applied for a Housing loan on that property Bank legal advisor asked me to produce a Power of attorney - a NOTORISED one in 1996 sep- which was used in a title share transfer within the family.
I contacted the THEN TITLE HOLDERS OF THE PROPERTY and found that the person issued the Power of attorney is NOT ALIVE and the copy of the document(P O A) not with them.
Since it has been a notarised one No other copy from anywhere is available ,. Only thing I could manage to get was a confirmation from the NOTARY PUBLIC about the issue of it on 19 sep 1996
KINDLY GUIDE ME WHAT OTHER ALTERNATIVE I AM LEFT WITH TO RECTIFY THIS

I am having one big property in the sate of Madhya Pradesh (M.P.), which is an ancestral one and at present mutation is in the name of me and my sister jointly and we both only are the owners at present.
My sister wants to transfer her rights in a very small part of the said property (almost 1/10th of the total property) to me.
1. is it possible via relinquishment deed ?
2. Can PARTIAL property be transfer by relinqueshment deed ?
3. For the purpose of stamp duty and registration of the deed , can it be treated as equivalent to sale and not relinqqueshment ?
Pls advise...

In a Plot of 200 sq.yds. there are 16 co-owners.All signed an agreement to sell in favor of Mr.Ravi to sell that plot except one Mr.Arun.In high court Mr. Arun said that he can bring a higher buyer for the property, high court gave him A time of one month to bring the higher buyer.
On next date,I was presented as the higher buyer in High Court,I bid 50 lakhs more than the previous buyer, yet court gave the property to the previous buyer as I was asked to deposit the whole amount immediately while no such condition was imposed for the previous buyer.Highly partial decision.Nothing was on record.Every thing verbal.Easily manipulatable and manipulated.
In the orders judge has not mentioned any FIGURE that what was the bid of mine/what was the bid of previous buyer/leaving scope for the earlier buyer to balance black & white money.Though he has mentioned that mine bid was the bigger one but I have not been given the property just because I was not depositing the whole amount instantly ,while the previous buyer was also not depositing the whole amount instantly yet he was given the property only because he was a previous buyer.
Now all the co-owners settled to sell the property to the previous owner.
HIGH INJUSTICE TO ME.I WAS MISUSED.MAY I FILE AN APPEAL AND ASK THE COURT TO DISCLOSE THAT ON WHAT AMOUNT THE PROPERTY IS BEING SOLD AND BOUGHT ?
WHY THE AMOUNTS WERE NOT MENTIONED IN THE JUDGEMENT?
CAN I BECOME A PARTY OF THIS CASE JUST BECAUSE I WAS A PROPOSED BUYER ONCE?
I AM YET READY TO BUY THE PROPERTY.
PLEASE HELP....

Dear sir,
I need a clarification in the following due to recent judgement by supreme court.
' A ' purchased land from' B' in 2009 and 'B " executed regd sale agreement cum GPA in favour of 'A" on 20-9-2010. 'A ' developed the land into plots and obtained permission hyderabad urban development authority and sold plots to individuals 'X' &Y'on 15-11 2011. 'A" had executed Regd sale deeds to "x"& 'Y' on 15-11-2011.
1. WILL ' Regd sale deeds to "x"& 'Y' on 15-11-2011 executed by 'A' convey proper valid title to 'x'& 'Y' ?
2. can 'A' legally execute the regd sale deed to 'X' & ' Y' ? since 'A' is only regd sale agreement cum power of attorney holder from 'B'.
Thanking you.

The seller refused to transfer the said property in my favour . i filed arbitration case as per ATS . I took an order u/s-17 of the Arbitration act against seller for maintaining status quo . Now It has come to my knowldge that te seller has already( before my ATS ) entered into an ATS with some other person and has now even transfered the said property to that buyer . Now what are the remedies available to ma as per law .
