Hi,
can an old tenant of a commercial property whose tenancy is registered under the firms name make a new partner taking xyz amount from the new partner and later withdraw his own partnership and make the new party 100% partner of ABC ltd and let him continue to start a new business without any landlords intervation or legal hassle,
for eg ABC ltd is having a commercial property, and having 100% tenancy right, and there r 2 partners of ABC ltd.
can the 2 partners take the market value of the property and transfer 100% partnership to the new party who's interested in conducting business in the same property

I am a tenant since 1976 in a commercial shop located at a prime location in Pune.
my landlord died 20 years ago and since then his son has not been accepting rent nor giving the rent receipts,I however have all the proofs that I had been sending him rents all these years through money order rpad and that he didnt accept it.
he has filed a case against me for eviction in the court, stating I am a defaulter in payment of rent.
I am ready to pay him for ownership as per market rates,he doesnt seem interested and says dont talk about the property.I have been conducting the same business all these years and the rent receipt is in my firms name.
my query is,can I start another business in my firms name without the landlord consent and without any legal hassle, like I said he doesnt even talk and starts abusing.
once the 2011 rent law gets passed I'll have to staart paying rent as per market rates which is not possible in my current business.

I have a case where a shop owner has given on rent to his son a shop in Delhi for a rent of Rs 45000.00 per month, the rental is not registered but a simple agreement on Rs 100 stamp. Now his son has found a party who is ready to pay a rent of Rs 80000.00 per month. the agreement has to be registered for 9 years. what the client wants is that as he has comitted a rent for Rs 45000.oo per month he does not mind letting his son have the extra Rs 35000.00 per month. How is the agreement to be made valid in law and the payment divided as above. The property is in the single name of the owner. Please advice the legality of the deal.
Thanks

Residential flat(in Mumbai)is jointly owned by Husband (1st name in the agreement) and wife (2nd name in the agreement). They have also filed a nomination form with the society in the name of their kids. My question is after the death of 1st owner (Husband), flat automatically gets transferred in the name of wife (as she is a joint owner of the flat in the agreement) or it will be transferred in the name of nominees (kids). Please explain the legal position.

Tenants applying for ownership of the property
There is on old chawl in Mumbai, since 1968. There are 12 tenants. The chawl is build on leased land by 2 partner owners. Rents were paid by tenants with receipt from the owner till 1976 after which the tenants stopped paying rents due to the owners neglected all the requests of repair of the property etc. There is no notice by the owners for the same. Tenenats do not have any proof that they paid the rents and the owner did not accept. Municipal property taxes are also not paid by the owners since 1976.
The municipal issued 3rd notice in the name of the owners for payments of the dues. Tenants are ready to pay the taxes. They wish to apply for ownership of their houses. Is it possible that the tenants can have ownership? What are the procedures to have the ownership? What are the hurdles and laws which cannot allow such?
