Dear Mr.Shroff and Mr.Sethi..
thank you very much.. for your advise. However, I forgot to mention that my society is a proposed one and apart from that it is situated at Mumbai. Near to Borivali. Further one of the person of my biulding has unauthentically modified the structure of the society e.g. he has expanded all the windows of her floor by breaking the side wall to certain extent.etc. can any action be taken against him on the basis of violating the law of Co op society and unauthorised breaking of side wall near the window by him. Pls note, my society has no share holding by the society members and books of accounts are also not maintained properly. In these conditions, would it be proper to appraoch the registrar?? Pls advise at the earliest. thank you.

Dear Experts
I am aware that Financial Bank Guarantee of 20% of cost of project is required from the developer. The developer selected by my CHS is providing an guarantee of RS 1 CR on reducing balance basis. He has refrained to comment on the cost of the project.
Question
1)Who determines cost of project?
2)Should such guarantee(entire) be valid up-to the completion of project or be on reducing balance basis?
3)What legal paper/document will developer provide to CHS ensuring such guarantee?
4)If the developer is a group company & the guarantee is taken by one company where as the project is done in other company ; is such guarantee valid/beneficial to CHS ?
5)Is performance guarantee also required to ensure timely completion of redevelopment project?
Kindly advise

Our CHS has selected a developer and he has requested
the society to enter into agreement/Mou.The appointed society lawyer has not been shown the agreement and committee members r favoring developer.I had made some research and found out the Development Agreement & Permanent Alternative Agreement (general idea)Therefore need to know
What is difference between Development Agreement & Permanent Alternative Agreement in redevelopment process?
Are both agreements necessary ?
Who are parties to these Agreement & at what stage(s) they should be executed?
Are these agreements subject to stamp duty & who bears the same?

Dear Experts,
My father had rented a Office in South Mumbai from Mr.X & was running our family business since 1948. Since then we have been occupying & operating our business from that office till 2007.We have been paying them rent for this office regularly till today some years back. The sons of Mr.X( he is dead now) requested us three years back that they want to use the said office for their work as the office was empty. We allow them without sensing their malice. We still have our furniture & other stuff there. Now these people are selling this office & telling us that we do not have any legal right on this office & hence would not pay us any money from sale proceeds. We have all the proofs our running business from that office. We use to pay all the office charges(electricity, maintenance, etc)
Can anyone tell us what legal right we have on our office. Can we get stay order on the sale of this office.
Please guide me.
Regards,

Hi,
My name is Madanlal(67 years) living in ahmedabad. We are three brothers and 5 sister. My father was having two property in Agra. In first property my younger brother was living with his family. First property is three times bigger than the second property. After my father's death all property were transfered to my mother's name. My mother decided to divide first property among two of my younger brothers and one of my sister(Widow). And the second property was for me. When the will was made i was not in india. In that will first property was mentioned and it was distributed among three of them. Second property was not mentioned in that will which was supposed to be my part.
Now, they have got their part but my property is still in the name of my mother. She died in 2001. I want to get it on my name but my one brother had signed NOC but second is not signing the NOC letter.
Also, I would like to draw your attention that in the will my mother made a thumb impression, but as i remember perfectly my mother was receiving govt pension and she used to sign the doc everytime. How can a person who know his signature will give a thumb impression on will.
Plz give me some advice.
Thanks
