Dear Sir,
The query will seem to be silly but it is an urge for a common man who is earning normal money by hard work which he doesn’t want to loose or waste just like that. Amidst this kind of house owners standing on the tenants head. I had seemed a lot of good house owners in this society.
I had shifted to a rented house by March 1st 2013. As per rental agreement I have to pay EB bill. But the owner said his house is newly constructed and the eb bill will come after one year. So he calculated the monthly eb charge on his own. For march and April 2014 I had paid what they asked(195 & 245).
Then by june 2014. He asked to give the Eb bill fixed amount 300 rs. But I refused because some month I will consume less. Its loss for me. Some month I will consume more, its loss for owner. I had told the owner that in future there should not be any confusions and demanding on this. But the owner Is strong on his fixed amount. Finally I am locked and I agreed for that amount.
By Feb 6th 2014 they had intimated that they increased the rent amount and fixed eb charge to 400 rs and if I am not afford for this increase I should vacate the house by March 2014 End(2months notice). I had replied that I cannot afford for his increase in amount and I will vacate the house by 3 months notice as per agreement and same they agreed.
As per my words I had vacated the house and handed over the key to the owner, asked to deduct the April 2014 rent in advance and asked for advance amount. But the owner’s wife said that she has to discuss with her husband who is in Dubai regarding painting charges. After 4 days they intimated my advance amount deductions.
1. When her husband came to India for vocation. he noticed that I had consumed 12 units /day. After vacating the house they are asking and I have to pay 200 rs additional per month calculated from August 2013. This amount is more than what they revised(400rs/ month) in Feb 2014. I had refused to pay and asked for proof of meter readings and eb bill. But they resetted the meter reading some day when they changed their single phase line to three phase. And it was not intimated to me. Since this deduction was not intimated to me prior to vacating the house.
2. Also regarding painting, agreement says tenant has to handover the house after painting it. I should abide by that. By the time of vacating they said they will discuss with painter and get the price and intimate me . After 2 days they informed me that they had painted the house and forcing me to give the charge for painting and It is also be deducted in advance. More ever the painting charge what they are asking is very high. Even I can do it in half of the price….
Finally the house owner makes lots of deductions in eb charge and painting charges by overruling the agreement. Now he is not releasing my balance advance amount. For my new rent house I got the advance amount on credit and paid. Kindly advise me. I don’t want others thing and I will not allow others to take my thing even its is 1 ruppee.

I reside in Kolkata. My father who was the original tenant of my premises passed away in 2000 after which the original landlord recognized me as his tenant and took rent from me. A few years later, he moved with his son out of the country and in 2004 gave me instructions to put the rent into a specific bank account which I have been doing since then. In 2011, I got a letter from a person who said he was the constituted representative, stating that the original landlord had passed away, he was the legal representative for their son and legal heir, and I was an illegal occupant as I had violated the contract. There was no date of death mentioned, nor was there any copy of the death certificate. If he has truly has passed away, he is survived by his wife, son and 2 daughters and any one of them could be the legal heir. I wrote back saying he should tell me which law I have violated and that he should give me proof of death and validate who is the legal heir so that I may pay the legal heir the rent. There was no response and I have been continuing to deposit the rent in the bank. Currently, I have no awareness of the whereabouts of the original landlord or his legal heirs as they have not communicated with me and earlier addresses are no longer valid.
Considering the fact that I have received no formal communication and no proof from the original landlord's family or the heir of this property about the death of the original landlord, am I within my rights to continue paying the rent into his account which continues to be active? I am aware that the different family members live in different parts of the world. I am not keen to go exploring who is the legal heir when I don't even have official communication about the landlord's demise. Do I have to still find out or is it okay to just let things lie? As I have not defaulted on payments, is my position secure? Would appreciate a legal opinion.

When a father/mother/brother/sister wants to gift a property(flat) to one of their family members then a gift deed is made.
1. How much Concession does one get in the stamp duty?
2. Once the deed is done the property is registered in the Donee's name and also transferred in the Society's records.
Do we have to pay any charges to the Society?
3. In future, if the same property has to be sold do we still require the permission of the original owner/doner?

I have read news in news paper that now there is no need to take permission from collector office for selling his land under section 44 of land revenue code as it has been amended due to huge corruption in revenue office. Please share the amendment on this

Dear Experts,
I purchased a 2BHK flat with parking space in Pune in year 2000.
Now, my society chairman says that since my Index-II says that my flat has an open space parking therefore my present parking doesn't belong to me. He is also threatening to through out my car parked in the same.
Whereas the same parking no. is mentioned and clearly shown & marked in the Sale Deed agreement.
Pls. guide and assist me to resolve this issue with society permanently.
Expecting a positive reply at the earliest. Thanking you , regards
During housing society meetings or any meetings in the beginning attendance is taken to decide on the quorum.
If suppose a law/rule is passed inspite of few / some members of quorum not agreeing to it, then still can the managing committee show the attendance of the quorum as a proof that everybody agrees to any law it passed?
I mean can any governing body show the attendance of a meeting as proof that everybody agreed to its point?
This is not any academic question but what is happening in our housing society where the committee is showing the attendance as proof of every bodies agreement inspite of knowing that all have not agreed to a point in the meeting.
