A Hindu father purchased a House in the name of elder son (out of 4 sons) meant for all the sons in the joint family out of his self acquired sources. All the 4 sons are married and living jointly in the same house. Mother dies 10 months back and father died two months back.
Now the elder brother is not accepting to distribute the property equally between four brothers. He says that it is his own property as his father has registered the same in his name.
How can the other three sons can claim their share in the house. Is the stand taken by the elder brother that it is his own property is correct.
I seek the valuable opinions of the experts.
Dear sir,
I want to know whether Maharashtra Rent control Act 1999 is applicable to other States of India. Is the Leave and License agreement entered into between Landlord and Tenant in other states other than under Maharashtra Control Act , are under the jurisdiction of Courts of UP or other states? More over sir I want to know is it compulsory to get Lease agreement of house for less than 11 months registered with the sub-registrar. In case of default of a registered Lease agreement, what are the remedies available to the Landlord? I am also attaching a Leave and License agreement (sample) kindly tell me if it is OK.

I have purchased agriculture property 20years back under a sale agreement.paid the full amount but could not register then cos govt had stopped registration.
Meanwhile owners filed suit for partition between family members to cheat us and after 22 years court has ruled in our favour stating that we are in possession and sale deed in not necessary.
Now with this high court and supreme court orders we approached the corporation to change khatas into our names but they are asking for registered sale deed which does not exist. Kindly help. Thanks in advance.

dear sir
my father purchased(through cheque) 40 acres agriculture land from his brother in 2001 , he has sales deed and registered power of attorney for the same and till date he has not done the registry of land.
now the problem we are facing is that my fathers quota of owning agriculture land already finished...now he wants to do the registry on my name and my sisters name.
At present the registry rate per acre comes to 5 lakh rs / acre so totals comes to 2crore.
IN POWER OF ATTORNEY IT IS MENTIONED THAT HE CAN SELL THE PROPERTY TO ANYONE OR CAN LEASE IT TOO.
CAN HE SELL ME AT 1RS/ ACRE AND I CAN PAY THE STAMP DUTY ?
ME AND MY SIS HAVE TO SHOW 2CRORE AMOUNT IN INCOME TAX RETURNS?
IS THERE ANY OTHER WAY THROUGH WHICH WE CAN DO THE REGISTRATION OF LAND

my father expired leaving his last will in which he has left all his property in name of my mother. i and my brother has signed indemnity bond stating that the we accept the will of my father and want to transfer the ownership of the property in the name of my mother absolutely. Society has already transferred the property in name of my mother name on basis of that indemnity bond. My mother has gifted me one commercial property by making gift deed, now my brother has sent the letter to the society stating that my mother is only the caretaker and she cannot gift or sale the property by anymeans.
as per the letter probate is the must and it is illegal to transfer the property by means of indemnity bond.
commercial property is purchased by my father
could you please tell me is it legal to transfer the property in mumbai using indemnity bond or probate is the must
