Sir
I am facing breach of status quo charge in an otherwise untenable civil declaration suit. Is it compulsory to register lis penden ( disputed property) with registrar in Gujarat.

Agreement In 200 RS stamp paper

Dear experts
I have agreement with my wife in 200 RS stamp paper that what I will get property from my deceased father property it would be joint in my name and my wife name has my son is minor the agreement was made in Dec 2016 my wife has submitted that stamp paper in court today I am not interested to give my deceased property to my wife in joint know she is telling after getting property in joint I know what to do has my wife deserted me from 9 years and I have made two different types of signature on stamp paper in front and back my wife has illicit relationship with someone I cannot prove to court if I tell to court it will ask evedience I don't have evedience to prove I don't want my property to jointly with here with me and my wife what best I do please guide me experts.

Recovery of loan from pvt ltd company against cheques

I had invested in a Pvt Ltd company for 5 lacs and against that I had 2 cheques as collateral.
The first cheque of 2 lacs did expried on September and the second has validity for another 3 months.
here when I am asking for money than company directors are responding that they will shut down the company to declare insolvency by december 2019.
Please let me know what can be done as they are not ready to pay any money now.I do have a agreement also.
I do not have money to fight with them. Whoever can help we can go for percentage once we recover. We are in total 3 people with 12 Lacs of money invested.

Appeal in session court against conviction u/s 138

Respected sir,
I have been convicted in sec 138 case and penalized with double the cheque amount and one year simple imprisonment. I have filed an appeal against judgement in session court who has ordered me to deposit 20% of penalty amount for the appeal to be heard. I am unable to arrange it. Hence, the session court has cancelled my Bail and issued NBW. I am left with no means to arrange the required funds. Am I left with any legal option to have my appeal heard or should I surrender and go to jail. My appeal has enough merit for acquittal, so says my learned counsel. I was denied opportunity to present my defense evidence by the trial court on ground of being not present for a month during which it closed the opportunity for me to lead my evidence, and order of conviction was passed.

Bu permission and selling restricted in gandhiangar

Dear Experts,
I would like to know the procedure to get the details from Hon Gujarat HC.

When Gandhiangar city established, government allotted residential plots to farmer because farmer's agriculture land was acquired by govt.
Also few plots were allotted to govt employee and other people. In year 2011, Gujarat high court banned selling of residential plots and houses.

Problem here is in ban, HC has not mentioned anything related to Farmer's plot but now Govt officers are not giving BU permission and also not allowing to sell the house. Other side rich people are going court and getting sell order so selling property

Is there any way to get the court case details ? How do I know that selling is really banned on residential plots given to Farmers ? Can I get this case details on based on RTI? Your help is really required. I am unable to get BU permission from Govt. Corrupt officers are making money and we poor people suffer lots.

Ownership of property

Dear Sir,

I stay in thane, mumbai. after marriage i used to stay with my inlaws. my inlaws was against our love marriage. after marriage my 5 sister in laws and father in law treated me very badly. I left that house with my 1 year old son. later on my husband also came to me. then we took house on rent. we used to visit our inlaws on regular basis and we were taking care of their monthly needs. my husband is in police dept. so he is always on duty to remote places. during this time i took care of my two sons and paid regular amount to my in laws for their needs. also we took care of their all medical expenses etc. we spent more than 2 lakhs for the marrige of youngest sister in law. few years back my youngest sister in law came to inlaws place for delivery and stayed with them because she was having disputes with her inlaws. even after this we took care of all the financial needs of mother and father in law. my father in law died in oct 2015. we told sister in law to go back to her place but she did not. now she is claiming that since she was staying with them all property including house, utensils, furniture jwellery and money and she took everything from us. even we are paying the maintenance of flat of my inlaws as on date regularly. even she is not allowing us to enter the house. can you help us in this matter. we dont want to sell this house as it was the only memory of my inlaws. as per the nomination of society we have 54% share and other sisters have 46% shares. please tell me how to proceed in the matter. we are not denying their share in father in laws property. if we sell that flat we will definately give them their share. now we just want to stop her from encrochment of property.

Applicability of supreme court judgement 2010 - nahalchand

dear sir,

supreme court judgement of nahalchand laloochand vs panchali co op soc dated 2010 is applicable for the parking allotment after 2010 or also for the transactions before the date of judgement. few member of our society paid builder for stilt area for parking. they r saying that this judgement is of year 2010 and they have purchased parking before 2010. i want to know whether the judgement given by supreme court is applicable for transactions before 2010.

Gratuity payment

Hi Friends,

I am working in NSE & BSE Listed company since 26th Dec 2014. I have resigned from job on 16th Sep 2019 and my last working day will be 15th Nov 2019. I will be completing 4 years 10 months and 19 days till last day of working. Please tell whether I am eligible for Gratuity or not? Also share SC judgement if any as my HR is confirming that they will pay Gratuity only when I will complete 5 years i.e I have to work till 26th Dec 19. Please also tell what remedies I have if employer refuse to pay the Gratuity amount.

'registered declaration deed' for boundaries correction ?

Hi All the experts,

Need advise on a property that i am about to buy.
I am planning to buy a plot (with house) which is situated in Bangalore, while verifying the documents i found that the boundary details are wrong for East, West and North.
Now the seller has told he will get a 'Registered Declaration Deed' with all correct boundary details.

Now my question is 'Registered Declaration Deed' fine ? Since the property is old and to create a 'Rectification Deed' the original party is not available.
