Bad judgments remaining unchallenged

(Querist) 09 April 2013 This query is : Resolved
Dear Legal Experts,
Namaste!
Because of judicial corruption, there are bad judgments for litigations. If bad judgments remain uncontested & quoted in other matters, will it not be injustice? Are bad judgments are reported in Law Reports? Was IDA 315 of 1990, Labour Court, Mumbai was reported in Law Reports? Judgment in IDA 315 of 1990 by Labour Court Mumbai was bad judgment & my appeal against same in HC was dismissed by Justice Nishita Mhatre without going into merits of the case & using her discretion to condon delay.
Do victims of injustice have to suffer because of bad laws & bad judges?
Best regards,
Navin Pandya

Forget about bad judgment or good judgement. Please tell what is your factual situation and then ask the query.

1.Trial court judgments either bad or good cannot be precedent. 2. If one party quotes bad HC/SCjudgment to swing the judge, you can quote anoter good HC/SC judgment. 3. If the judgment is bad because it has not been followed the law settled by precedents delivered by the superior courts, you can appeal it. 4. If any so-called judgment will affect a large number of people in future, through PIL one can impugne such judgment.

There is no word like 'bad' or good in judicial system. You can file an appeal before the upper court if you are not satisfied with it.

Dear Legal Experts,

Namaste!

I am party in person & understand that I commited mistakes.

I went to Labour Court, Labour Commissioner & Other Higher Authorities seeking justice. On following up with Labour Commissioner, his office took the stand that the matter is in court & did nothing. Can the Commissioner's Office take such stand instead of initiating the conciliation Process? In fact, the Labour Officer who initiated the process was transfered and his woman successor took the stand that matter is sub-judice.

Now all said and done, I kepy struggling for justice, rightly or wrongly. I pray for justice, how the situation can be salvaged to get justice?

Kindly help.

Best regards,

Navin Pandya
