Ancestral property

Respected lawyers i am expecting dv act any from my wife and property in which i was residing is in my grandfather's name and written WILL in my father and uncles name. Does court consider it as ancestral property or inlaws owned house?
As of now i have moved to different state and staying on rent

No sir grand father had expire. And made will in which my father and chacha have 50-50 rights and there after property is not probated

To your specific question - the answer is - it is not ancestral property.

But in what way the status of your father's property is connected with your anticipated DV case?

Thank you experts, Its actually in mediation center wifes lawyer were shouting that they will file DV act and enter my house(which is my permanent house) and then we pay them 50 lac. or will it be considered as shared house

The threats are usually made to fill the opponent with fear due to his ignorance about law. You need not be afraid of that, if there was no incidence of domestic violence.

The tactics adopted by the opposite lawyer is a usual one to appease their client for the purpose of extorting fees. Since it is no way connected with ancestral in nature, even if it is, for the present you do not have to worry about it. Let them come out with such a case, it can be challenged.

Threat posed by the lawyer of your wife in mediation for filing DV and enter in your father,s joint property is merely a tact of hawking legal profession to show his efficiency, so you may ignore it.
