Querist : Anonymous (Querist) 15 September 2011 This query is : Resolved
My wife has put wrong 498a on me and under her complaint she is falsely claiming that they have spend 5,00,000 on marriage and 1,00,000 on ring ceremony.

Can they procure fake bills for same. If yes, how can i counter same through RTI or other means.

Kindly guide. Thanks

Kindly guide. Thanks

The amount spent on Mariiage and ring ceremony even if supported by Bills wont matter as these are expenses incurred by them as per there wishes and in no way was given to you as Dowry.

You cannot get these information from RTI because the vendor, mandap keeper, caterer etc., would not be public authorities. You can get information through RTI only from public authorities and not from others.

The matter is not covered under RTI,defend the case and cross the complainant at the time of trial to show documents before the Court. If they would not able to submit proper documents, which may be a matter of Income tax Authority, how they got this amount.

Criminal case under section 498A is not meant for any recovery of expenses incurred in marriage. This section is only against causing harassment/humiliation/demand of dowry etc. so do no worry. Let her claim crores incurred in your marriage. Unless it is specifically pleaded and established that you forced to give dowry till then these allegations have no value before eyes of law. trust upon your lawyer defending your case.

I strongly support the view of Ex. Raj Kumar Makkad.
