Wrong information under rti

Dear Sir,

Kindly let me know if there is any govt. officer giving wrong information under RTI Act then what we can do.

I have recieved such wrong information from Assistant Police Commisioner of UP ( Dist- Siddharth Nagar).

I want to do complaint against this officers.

I am afraid, one can make an appeal to the First Appellate Authority in case the PIO does not furnish the information within time.

But on what basis one will be able to State that the given information is wrong?

At best, one can again make an application to the same PIO, attaching the (i) information provided by the PIO under RTI; and also (ii) the information (probably document) available with the querist [on the basis of which the querist says that the information provided by the PIO is wrong] and ask appropriate question to elicit the requisite information.

More than this, I don't think that the Querist will be able to make any appeal to the Appellate Authority under the RTI.

I will be happy to stand corrected.

sir, above suggestions are discretionary options. But I suggest the applicant to make a complaint under section 18 of RTI Act to the concerned State Information Commission by establishing that the PIO has supplied wrong or false information. the SIC is competent to initiate action beside imposing penalty. the relevant section 18(1)(e) of RTI Act says that "18. (1) Subject to the provisions of this Act, it shall be the duty of the Central Information Commission or State Information Commission, as the case may be, to receive and inquire into a complaint from any person, (e) who believes that he or she has been given incomplete, misleading or false information under this Act"

How do you know that the information furnished by the authority is incorrect?
Please again ask the PIO to let you peruse the file as well as take zerox copies of the information, which according to you is genuine.
The you can make a complaint u/r section 18(1)(e) of the RTI Act.
Your success depends upon your dogged pursuit of the matter till the end, so that it would be a lesson to other PIOs.
