In a civil suit regarding dispute of land in Moradabad, the Defendant has not filed any written statement for the last more than 5 years. For which he has got permission from the learned court to file it now, which should have been permitted as maximum time to file is 90 days. On that ground, if we protest and the judge refuses to take on record. What are the implications for want of WS. If decree is decided against him, can he go for revision.

Did you insist the Court to struck off defence of the defendant for non-fling of his WS within stipulated time? If so, what was the reaction? If no, whether the Court has proceeded ex-parte?

Dear all the experts & leaned lawyers,

Thank you very much for the opinions & guidance. My local lawyer is of the view that if the court proceeds with ex-parte, defendant may go for revision and a long process ahead. Don't know whether his approach is right or not ?

The plaintiff and court process can't be held up by defendant for his illegal designs.
Request the court to struck off his defence and proceed ex-parte as per law.

what is the definition of experts pls? none can claim he is an expert .if he or she does naturally his or her education obviously stunted - learning is perpetually growing depending on issues, that way courts came into being - see what Nasscom says - see what ICJ said, what Pakistan said and see what india has said - in that you can classify politicians are mostly from school drop outs or fake degrees - 'fact is the IT personnel were not appropriately skilled by very colleges nor by their own employers when so how the outsources would use these worthies - why cry hoarse , fact is world needs every day something new that is the real news if you don't posses customer friendly skills you get in to obsolesence faster than ever before - simply reskilling doesn't exist when u lack properly backed by theoretical studies too - so universities inn india just failed - don't simply be carried away by 'Manki bhat' man, who is good at heart he has to strategies to help - you can't never get strategies as most of them as RK Laxman called school drop outs that only land in politics and political gaming - see yesterday what your inf and broadcasting minister said 'we have won in ICJ' not realizing you have a long way to go to save Jhadav if he is still alive in Pakistan - it is a known fact , any one not implements ICJ orders just get away with 'sorry from the rogue govts - see r=even USA played with Germany and so many - so Pak has a lot to play 'duck - what we won in ICJ a 'stay' not saved from 'gallows'; first jhadav need to be alive if not what we won ; or if we win after consular access u need to win the matter at Pak SC against Army court marshal order , so without realizing we talk like media does so the ministers obviously worse than 'school drop outs' what RKL said. facts are different that is based on 'ground realities' not some 'slogan mongering; like Pak foreign minister saying ICJ don't have jurisdiction ' i can do what i want' but again changing some 'legal team - issue is 'India approached after 16 requests for consular access that way what the Pak minister saying is not that easy too.
Ministers have a knack or politicians just to keep the people at 'sixes and sevens;' by so called 'mis information. Just egging fir second term in india for BJP, before actually 2019 results are known nothing is sure, till the cat is out of the bag!

i am not writing here for yr great expert opinions but i say written statements once given just limits you not to retract - provided if filed in time else may not be accepted due law of limitation...
