Understanding will

Respected Sir,
My father wrote a WILL. He died in 2004 in an accident. In the WILL he has written that all property owned by him or cash/property receivable by him from his family, friends, his accounts etc. shall come to me. Now I have applied for General Insurance compensation in the court. Am I entitled to the whole compensation as per WILL or do the other legal heirs have right in this General Insurance Claim? Please answer this query in the light of the WILL of my father.

Sir, the other legal heirs have no rights,if your fathers property.But claim case they are having full rights.

As per will only you have legal right to retain the accumulations of general insurance.

If courts case relates to claim of his accident due to which he died.all are entitled because that is not an asset left by your father,i do not know reason why one differs with opinion put forward by Expert Rajendran.m !

Yes, Mr Singh is right.
The compensation to be given by the Insurance Company has nothing to do with the terms of the last testament of the deceased.
The award would be equally distributed among his legal heirs.

The award of the court through this MACC case is not the property of the testator about which he could make his last testament.

The querist is quite aware of the implications of the contents of the WILL. That is why he has put this query to get further confirmation/clarification from this Forum.

I completely agree with the views of Mr. Rajendran which was supported by Mr. Prabhakar and Mr. Barman.

The insurance claim will go by way of inheritance amongst all the legal heirs of the deceased and the WILL left by the deceased does not cover the insurance amount.

The querist has not asked anything about MACT compensation rather has asked about general insurance accumulations may those occur due to loss of any property etc. The querist only shall be entitled to inherit that amount. MACT compensation is really not covered under the perview of will.

"Now I have applied for General Insurance compensation in the court."Accident already stated,hence we anticipated so.

General Insurance is not a life insurance(premiums never accumulate here),it insures goods,life and vehicle,for which a court case is pending is the suggestion gathered by us.
Any way it is not a serious dispute when he has got opinion on both the possibilities unless you disagree with our opinion in possibility of case being as anticipated by us.
I DO NOT DIFFER with you in case your anticipation about the fact is found correct.
