Token amount

Hi ,
One of my friend have booked a flat nera by mumbai , and he has paid Rs 100000 as token. Now h donot want to purcahse the flat due to some financial problem . Caclaim back his token amount???
If builder doesnot agree can we file a case against him

was payment by cash or cheque . does he have receipt / what were terms of booking?

10K was paid by cash & 90K by Chq.No condition as such mentioned in the receipt
What action he can take and how??

YES, U CAN FILE RECOVERY CASE AGAINST BUILDER WITHIN 3 YEARS FROM DATE OF PAYMENT.

First of all demand the amount orally failing which make written demand the then legal notice and only then civil suit for recovery.
