(Querist) 02 December 2013 This query is : Resolved
Dear Sir/Madam,

I will be highly obliged to know whether

Q1>if I complete 3 years LLB through correspondence course, should I be allowed to sit for the Bar council exam to become a practicing member or to have a license?

Q2 > What are the possibilities to become a practicing member of Bar Council and get a license after completion of MBL or LLM?

Q3> What if I complete Company Secretary Professional qualification. may I be eligible to get the License?

Q4> I am 38 years old and want to pursue law as my second career, how best possible way may I start?

Looking forward to the reply of all honorable seniors.

With deep regards.

There is no correspondence course for LL.B.

Even if some institution offers such a correspondence course, the same is not recognised by Bar Council of India for the purpose of enrolment as an Advocate.

Therefore by obtaining any such degree through correspondence, one cannot practice as an Advocate.

By completing Company Secretary examination one can practice as a Company Secretary and not as an Advocate.

The three year regular LL.B. course (not correspondence) should be pursued. Such courses are available in the evening hours in places like Delhi. You have to check up in your area.

Dear Anirudh Sir,

Greetings of the day,

I would like to know what is the maximum age limit to pursue LLB course as it is still not clear from the web, or sites. one more thing there are some part time courses LLB courses are there, and Correspondence courses as well, my question was. Is there any option after completion any of those courses, may I apply for the BAR COUNCIL EXAM. or not?

Second thing Company Secretary course manual says that after finishing professional qualification one can do the advocacy for the company at the court for that purpose one need not be advocate. That means a CS can do the advocacy at court for his company is it right?

Regards,

Anthony

Anthony,
Correspondence courses of llb as stated by other experts are unheard of. Make sure you do not get duped by some fake ads. Even in the US there are night law schools for working people because legal education at graduate level is not imparted through distance or correspondence education. Age limit is unclear in India because several cases are going on at various High Courts with regard to that. Probably because decision is pending, you did not find a clear cut off age limit.

There are correspondence courses being conducted by some universities but they are for academic purpose, a graduate obtained a decree through correspondence is not eligible for practice as an advocate,it will be reckoned as a law graduate only. Such persons can be absorbed as legal officers of some companies. Next about the CS, once a person is a qualified company Secretary, he can appear before court advocating for his company because the course syllabus contains law subjects which makes it eligible but it will be restricted to only that company who he represents, he cannot practice law in general.

You have rightly been advised by the experts so no more to add.

1. LLB through Correspondence courses are not recognized by the Bar Council.
2. Both degree are eligible if basic degree (LLB) is from recognized institution.
3. Company Secretary without law degree can not be enrolled as a lawyer.
4. Overage for enrollment as a lawyer after receiving a degree.
