revenue dept land survey map measurment is final or can be a

I bought a land from its legal owner. I calculated the area of the land based on the patta and the measurments given the land suvey map of revenue department. Now the neighbor does not agree with the boundry. What is the legal position/soltion.

Let her disagree. Untill and unless the neighbour disturbs your peaceful possession you need not do anything.
If he does then file a civil suit fore declaration and injunction.

If neighbor disagree, let him approach law. If he disturb your peaceful possession, file suit for declaration and injunction.

You are valid titleholder and in possession of the land, just wait and watch the action(s) of your neighbour and act accordingly.

Sit and talk with your neighbor.. both apply at the municipal office for getting the land measured properly and get it demarketed and live peacefully.

Sorry severe difference of opinion

1) Land Survey matters are handled in different way .

2) From your wordings I make out you are not from Maharashtra , the words you have used

3) Go to Land Record Dept. of your area

4) Apply for measurement of Plot by authorities under Land Revenue Code of your state

5) They will issue notices to all , including neighboring plot holders even if you are doing measurement of your own plot, so boundary dispute don't take place

6) Boundary is defined by Land record dept of State Govt (Not Municipal Corporation because border plots , village plot can overlap , so most probably which I believe will be under state govt and it can not be under local govt due to technical things )

7) If there is dispute you can appeal again to senior officer , there additional measurement can be done name I forgot may change from state to state.

8) This process requires assistance of two department 1) Advocate who knows Property law 2) Survey Person/Architect/Civil Engineer who knows to measure plot properly.

9) Additional to Govt. survey officer you need to keep private properly educated survey officer

10) This Survey officer people some time who go and do measurement are not that educated but above 10 - 15 survey person there is Technical Person whose minimum education is Dp. Civil/ with knowledge of surveyor but he is too loaded so can not give time for your one case and can not do site visit .

11) To solve this problem you require assistance of Land Record Dept , Private Surveyor and Property Advocate of your state. One department will do disaster for this problem

12) And remember this border dispute of Land is very old but unfortunately people from city have lost touch with land only builder , Architect ,Civil Engineer are now aware of it

So if you are in city then contact Architect or Civil Engineer plus you require assitance of local Advocate dealing in Land Revenue matters. (Those who are not dealing in Land Revenue matters are not useful in this case)

(This all information I gave from Maharashtra state , you need to check your state as modification takes place)

See in such cases it is also observed

1) Either of neighboring , measurement on record and measurement site plan have error

2) This is also one main reason why such dispute takes place

3) Some land area is mentioned more , some land area is mentioned less

4) There is detail procedure to rectify land measurement

5) This is done within scope of state Land Revenue Code . Most state have single integrated Land Revenue Code . This is main Act of land additionally there are various acts for land.

6) In Maharashtra jurisdiction is within scope of Land Revenue Authorities , Since it is technical and legal field combination.

7) There are 2-3 appellate authority within scope of Land Revenue Code

8) This technical issue of your plot and neighboring plot have to be solved and understood properly before jumping to conclusion

9) May be neighbors plot have measurement error , while doing measurement of that plot person may have done error so this is technical aspect which requires to be analysis with Land Record Dept

10) So both Land revenue advocate and Surveyor help your sort out problem

11) Just fighting is no solution you will fight for generation instead determine if the problem is technical some where

12) And inspite land Record department clearance of borders etc. She encroaches then it will be civil /criminal matter else it will be Land Revenue matter

1) Since modern technology is available easily like Smart phone , While doing measurement kindly record measurement on camera and save the data properly .

2) You also need to make arrangement for Chuna , border pillar , Iron fencing (Brick wall takes time)

3) And with help of Land Record dept you have to fix this thing. And should be maintained properly.

4) If there is dispute or in appeal there is change then only as per appellate surveyor (Govt) change border. Don't do personally

5) Once clear construct proper wall , If bigger was is not possible due to financial restrain you can construct wall , with better foundation and little wall above ground level

6) If foundation is strong when you have fiance same wall can be increased , but if foundation is weak then whole thing you have to do again . I prefer you foundation of wall should be better so it can be increased comparatively easily

7) This whole process is practically costly process (Govt fee may be ordinary but reality lot corruption takes place)

8) If you want to save money and not give to corrupt officer , at time of entering land record dept. simultaneously meet Anti Corruption bureau people , who can guide you and get assurance (which generally they do) if your work is legal they will get it done

9) So your money is saved , else you never know what big mouth this land record dept opens. They have made business and land revenue dept is top 3 corrupt dept of state
