Removal from service of class 3 employee of lic of india

(Querist) 29 August 2011 This query is : Resolved
Sir
What the class 3 employee of LIC of India should do, who has been removed from service, either to file a case in labor court or to high court?
What should be the right path for a removed employee to get the justice speedily?
Raj Kumar Makkad (Expert) 29 August 2011
He can take recourse of labout court as well of civil court. High Court is definitely a speedy recourse.

I think you have appellate authority.. If alternative remedy avialable in your department mean you can't approach the court of law for your remedy.
K.S.Srinivas (Expert) 30 August 2011
I agree with Mr.Tom.

First file an appeal to the appellate authority in your department. The appellate channel has to be exhausted. If the appellate authority has not modified the punishment, then file writ in the High Court.

Agree with Mr. Tom. You will first have to exhaust departmental channels of appeal, etc. to the appellate authority. On rejection of your appeal, you should take shelter of the appropriate legal forum.
prabhakar singh (Expert) 30 August 2011
Yes Mr.Tom is right ,no court will entertain the matter unless domestic remedies provided for by any statute is exhausted .
mahendrakumar (Expert) 30 August 2011
since, you being a class III employee of LIC,you might be terminated by the divisional manager.

as such,You can first appeal to the concerned Zonal Manager and finally to the Chairman of LIC.

after exhaustion of above 2 channel only,go to High Court,Labour court will be more time consuming.

as far as LIC's work culture,if you have even a remote justicification in your case, chances are that, your dismissal will get revoked from the above channels.

you will get help from your unions too, unless your case is of severe fraud or such matter.

I am agree with Mr. Tom & Mr.Mahendrakumar.Follow both to of them to get easy pass out.

Removed from services:-

On what grounds?
Whether the departmental inquiry was conducted?
Whether the opportunity to you was given for proving your innocence?
