(Querist) 11 February 2016 This query is : Resolved
Sir i have borrowed a sum of amount 50000

from my relatives.

For a proof he asked me to write a matter on

a plain paper , that you have borrowed

rupees from me and you will repay me on so an so date.

And fix the one rupee stamp and signed on it by me.

What he said i have done it.

But due to my financial problem i am unable to pay the amt on time.

I need more time.

Now he is threatening me that if you wont give the money on time i will give the police complaint an file a case against you.

Sir plz... suggest me.

You are liable to repay the money as promised. You can plead some more time to repay due to financial condition. It may not look nice to seek other ways.

First of all, borrowed money must be paid back. If you need some more time , you can inquire him for it. For getting back own money can take help of law. And if he is asking for more money then he has given to you adding illogical interest, you can take help of law

Ask him to give more time to meet your liability.

However, this is civil matter and police may not intervene.

Dear Mohammad,

Moral to repay etc., is on one side.

Now, when he is threatening to take action, we have to think how to face it legally.

1. Police has no role to play in this matter. Therefore, do not worry.

2. He can file a case against you in civil court for recovery of the amount on the basis of the receipt given by you.

3. Whether on the basis of what is written on the paper signed by you, he will be able to succeed in the case is to be seen. This can be done only by a lawyer. Presently, none of us are aware about the exact content of the paper signed by you.

4. Therefore, firstly, you request him to give sufficient time to you to repay the amount.

5. In case he does not agree, then wait till he files a case. Once he files the case, you can approach a local lawyer for appropriate action to defend you legally.
