refusal to receive registered letter by registered club

(Querist) 21 July 2011 This query is : Resolved
I am a member of social club, which is registered under societies registration act and I wrote letters to the club authority on certain voilations of bye-laws and the need to rectify them with some suggestions there-on. The letter was a registered post with acknowledgement due and the club authority wantonly avoided to recieve it and hence returned as unserved. Is there any legal remedy to enforce the receipts of such letters and whether non-reciept of letter is violation of law.
adv. rajeev ( rajoo ) (Expert) 21 July 2011
being a member of the society you the act of the office bearers of the society can be raised in the meeting of the society.
Raj Kumar Makkad (Expert) 21 July 2011
Merely writing letters should not be your aim. Letters are written just for intimation and rectification but if those are not followed then further action can be initiated.

In the given matter, if you have to initiate further in any court of law then your returned letter shall be presumed as delivered to the society.
Advocate. Arunagiri (Expert) 21 July 2011
You can address all your grievances to the Registrar of Societies, in which your society is registered.

You have not mentioned, what exact remarks have been given by the postman on the letter while returning the letter undelivered.

However, you can raise your issues in the annual general body meeting of the club in the presence of all other members.

You can also send your complaint to the Registrar of Societies, if you have noticed irregularities in the functioning of the club.
Devajyoti Barman (Expert) 21 July 2011
Since it is the registered society , you can lodge complaint with the Registrar of the Society.

Alternatively you could file a suit for injunction as well.
RAJU O.F., (Expert) 22 July 2011
Refusal of the registered+AD letter, amounts to due service of the letter. You may proceed as if letter was received and not responded.
