Reasons of Speedy Trial of Case.

What are the normally accepted grounds by the courts for speedy trial of matrimonial case (day to day basis)as per section 21B of Hindu Marriage Act.

Can judge use his discretionary powers to speed up the case on day to day basis under above section

This section can be applied subject to number of cases permit particular judge to do so.

No special ground is there like health problem etc.

The trial court has no power to fast track the case pending beofore it ignoring the other cases. So the litigant need to move in the High Court for obtaining necessary direction upon the trial court to finish the trial of the case within a specified time.

That provisions was inserted in the statue book with a noble visions, but considering the rates of growth of divorce in the Country the very provisions has been frustrated by flood gates of matrimonial litigation.Time has come to set up a seperate Tribunal to deal exclusively with matrimonial issues and litigations.
