Querry about Hindu Law.

Querist : Anonymous (Querist) 01 November 2010 This query is : Resolved
Respected Experts,
Plz. clarify the following doubt.
“A” is the adopted son of “B” and whereas “C” is natural father of “A”. The adopted father has given some landed property to “A” and the natural father also given some landed properties to “A” with love and affection.

I came to know that an adopted person shall not be entitled to get any property/properties from his natural father, who gives with love and affection on him.

How it can be maintainable as per Hindu Law, in case if it is carried in a dispute.

A person owning a self-acquired property can dispose it of in any manner that he likes. He can give it to a total stranger. Thus, there can be no objection, if a natural father or father who adopted gives any property to the said son. There is nothing wrong. There is no objection in the Hindu Law for the same.
Adv Archana Deshmukh (Expert) 01 November 2010
A self acquired property can be gifted to anyone. If it is gifted to a child given in adoption, it is perfectly valid.
Kirti Kar Tripathi (Expert) 01 November 2010
i agree with experts. in case, the property is self acquired property of a person, he can gift to him but if it ancestral property, the same can not be gifted to the son by natural father as the son has ceases to be member of family.

There is no bar by any law to gift the properties to his son who has gone in adoption, if it self acquired property of the natural father.

With due regard to all the Experts participating in the Lawyersclubindia, the answers such as "I agree", "Yes" or "I agree with the experts" should not be treated as answer to the query and all experts should avoid making such comments just to improve their status in the "Hall of Fame". I am sorry, if I am hurting my friends. I expect a real opinion should be posted by my friends.
