Sir, my name is Asif Ahmed Chandsha from goa i am hanafi muslim. My paternal grand father's maternal grand parent had a property somewhere in karnataka which was not known to us, now we have heard that, the property has been sold by govt. to some company and the amount has been credited in grand father's maternal grand parents name, they had 03 childrens, 02 son and 01 daughter and we are from the daughters side that is she was my paternal grand father's mother.
Now our problem is that we are not getting the record of my paternal grand father's mother. Pls advice how we can prove that we are the legal heirs...

You are advised to file a succession case through your local advocate where your maternal grand father's maternal parents lived.

it would be next to impossible to find records more than 150 years old . at that time hardly any birth/death used to be registered . there was no ration card in those days .

Seems to be a very difficult case. Unless you are able to establish that u are the legal heir of the concerned person, ur claim for the money will not be entertained by the Govt. You have stated that the Govt had sold the property. How and why the sale was effected? Under what Act? Was the sale effected by the municipal corporation for recovering tax dues? you have to ascertain all the details and take help of of a local Advocate, who will advice u on the further course of action.

If you get the proper record of the property and linkage of your grand-father with his parental grandmother even then law of limitation shall come in the way and moreover the law of succession is not so easy in Hanafi Muslim as Hindus have. There are many ifs and buts in the succession a deceased Muslim so it seems this is nothing but a futile excercise to open the closed chapters.
