i am a defence officer and recently got posted from vishakhapatnam to jamnagar. i had booked my luggage and motor cycle from prashanthi cargo movers on 19 jan 12. however when i enquired about the luggage status on 15 feb 11 i was told it would be delivered by 18 feb 12. again on asking the status on 18 feb i was told that luggage is still in hyderabad and would reach jamnagar in a week by 25 feb 12. later the person stopped picking up my phone. thereafter after repeatedly calling the mobile was picked by an employee of the firm and he told me that the owner has gone to gujarat as the truck in which my lugguage was there has been seized by sales tax dept, he however refused to give his owner's mobile no. neither told present location of truck. as on date i.e 02 mar 11 i have still not got the luggage.

sir i wanted to know how to issue a legal notice and what should that state. also i had not insured the cargo. does that affect in any way. may i know whether i should lodge an FIR also

You should engage a lawyer who shall prepare a legal notice as this can be issued only by lawyer.

Get the professional services of a lawyer to send a legal notice.
You can claim damages and compensation for the delay, mental agony and harrassment from the service provider for their deficiency in service.

with regards to your reply may i know whether the services can be availed online from this website. also i would like to know that his terms and condition states that max delivery time is 90 days. does this mean that i cannot file a case for non delivery of items till 90 days are not over. Presently when i spoke again it has come to light that he has sent my luggage on 02 mar by AFL logistics. can i file a case against him for non delivery of items by his firm and by some other firm and also a case for harassment.
