Postal department's action

Recently I had shifted my residence (process is still not complete). My earlier house is used by my friend.
I am a practicing management consultant, with a name as V... Consultants (sole proprietor). operating below service tax limit.
All my mails in addressed to V... Consultants were delivered for the last fourteen years.
The post man got changed again now and he has refused to handover the mail.
Went to post office and the person to whom my postman took me to, said that unless a board is put - because it a company and a commercial place he will not deliver the letter.
My house is neither a commercial place nor my company is registered as a company under companies act.
Is the postal authority right - under which law?
Many CAs and lawers have home based office .... is a management consultant / charted Engr prohibited from having one such.

Your description is not clear. You have stated about shifting of residence, but side by side stated that the postman was delivering you the mail for the last 14 years, but you have not stated whether the new postman refused to deliver mail at your old address or the new address?

The Postman is liable for imprisonment upto two years if he hands over any article (even unregistered) to anyone other than addressee.

if company is the addressee the premises are not the official address of company then he is under obligation not to deliver.

68. Penalty for retaining postal articles wrongly delivered or mail bags.

Whoever fraudulently retains or willfully secretes or makes away with, or keeps or detains, or when required by an officer of the post office, neglects or refuses to deliver up, any postal article In course of by post which ought to have been delivered to any other person, or a mail bag containing a postal article, shall be punishable with imprisonment for a term which may extend to two years, and shall also be punishable with fine.

Thanks for your clarification, but sorry to say that the position explained by you is totally incorrect, as you seemed to have read between the lines of the provision of section 68 and the Act, as well. Section 68 is not the correct section to be applied on any of the official of a Post Office, including a Postman.

The penalties and procedures pertaining to the offences by the officials of Post Offices are covered only under Chapter X of the Post Office Act, that consists of Sections 49 to 57, NOT 68.

You may like to recheck the position to verify that.

Your purpose today also was to; TO insult Mr.Sudhir Kumar and me.

I never used any kind of damaging language against anyone.

Rather I have been gentle and respectful to everyone.

Due to the picture of a very old and sick man that PSD ( Double horn/Dual ID’s) shows and his critical stage I had avoided the damaging, abusive, indecorous attacks and extended my threshold limits for him.
