Police not disclosing full info

(Querist) 11 October 2014 This query is : Resolved
My husband threw me out of the house for want of money(earlier) and then filed a complaint against me and my parents. The police did not consider our side at all.
We were not given copy of the complaint. Then I filed an rti and after 3 months I received SOME docs today.

His complaint under "domestic violence, inhuman treatment and mental harassment"
-that I am sadistic, mentally and physically unfit to be married and impotent
-that my dad and my relatives have threatened him
-that the same he had informed his hr and after that I wrote to his company
-that co told him your family matters have reached co so you must resign.

Further, although I had asked specifically for ALL the docs copies, they have only sent his complaint xerox copy and nothing else like closure report. Also the day they had called us to the police station his complaint was hand-written. Now his complaint is printed copy with his signature.they have not mentioned the complaint no.

1.Does it mean that the matter is still under investigation? How can I obtain the remaining?
2.Appreciate any interpretation of his complaint also.
3.Can I make use of Rti to obtain any more info about this?
4.Please guide me to proceed further

Dear Qurist,it seems like you are victim of domestic voilence , dowry threat and mntal and physical torture. You can apply for the copy of all investigation and reports , complaint from the police station but better you take help of any RTI activist or specialist to obtain it from under rti application as rti have also some complications which somtimes normal people failed to understand. Also you are advised to filed criminal complaint against your in laws for your victimistion and if you dont want to file the criminal complaint til then simply complaint your matter to the National women commission and human right commission against the polic and in laws for wrongly harassing you and your family. And one more thing you dont have to feel upset and depressed as IANDIAN LAWS are female dominanting and there are vrious provisions and acts in indian laws hich can provide you justice and send your in laws and husband behind bars.Feel free to call if you hav further quries and need assistance for filing rti ad complaint bfore national women commission.

No not filed anything yet. My lawyer said that these things are common and that these kind of stories are made up all the time, so he said no need to do anything.

You clearly started your query saying "My husband" but some of the responses thought you are husband and you are complaining about your wife. So, some of the responses are so ridiculous, just ignore them for the above said fiasco. Now, the allegations leveled against you by your husband are domestic in nature and he is not entitled as per Domestic Violence Act to invoke the provisions of that Act against you. He is also not entitled to invoke Section 498-A. Husbands are not allowed to file complaints under these. Once you saw a complaint in handwriting but now you received a typed complaint. Your husband might have given typed complaint lateron at the request of the police. You applied complaint under RTI. While drafting RTI application, take care to ask the documents clearly mentioning what documents you require. If you do not know actually what and how many documents your husband filed, then draft it like this - "please supply me all the complaints that Sh..........filed against Smt........... and/or her parents, brother. If the complaints have been accompanied by any annexures, please supply all of them leaving nothing. Please also inform me that what action has been taken against those complaints. Kindly provide me the remarks made by the police officers in respect of those complaints. Who is the investigating officer in respect of these complaints. Whether any FIR has been lodged after receipt of this complaint. Whether the matter has been still under investigation or if investigation is completed, what is the result. If the matter has been referred to any court for trial. If so, give the name of the court." Then you get proper information. Above all, you need not to bother about this complaint. In fact it is NC complaint and gets a diary number and the police would do nothing on it. It appears that your husband has filed this complaint to prove cruelty against you as he is proposing to file divorce case against you.
